Nakatatanggap ako ng liham mula sa pribadong paaralan ng anak ko na humihiling ng donasyon upang suportahan ang kasalukuyang pagpapatayo ng multi-purpose gymnasium. Ayon sa liham, gagamitin ang nasabing gym para sa mga aktibidad sa paaralan at mga kaganapang panlipunan ng mga estudyante at guro. Kailangan ba ng permit sa pagsasagawa ng ganitong uri ng solicitation? Nais ko sanang maliwanagan sa paksang ito. Salamat. Solei

Malalim na nakatanim sa kaugaliang Pilipino ang diwa ng bayanihan. Likas sa kultura ng mga Pilipino ang pagtulong at paglingap sa kapwa. Kaya kinailangan maglagay ng malinaw na patakaran para sa mga nagsasagawa ng donation drives. Nakasaad sa Section 2 ng Presidential Decree No. 1564, o mas kilala bilang Solicitation Permit Law, na kahit sino—tao, kumpanya, organisasyon, o grupo—na magsasagawa ng donation drive ay kailangan munang kumuha ng permit:


Section 2. Any person, corporation, organization, or association desiring to solicit or receive contributions for charitable or public welfare purposes shall first secure a permit from the Regional Offices of the Department of Social Services and Development as provided in the Integrated Reorganization Plan. Upon the filing of a written application for a permit in the form prescribed by the Regional Offices of the Department of Social Services and Development, the Regional Director or his duly authorized representative may, in his discretion, issue a permanent or temporary permit or disapprove the application. In the interest of the public, he may in his discretion renew or revoke any permit issued under Act 4075.”


Ang Department of Social Services and Development, na ngayon ay kilala bilang Department of Social Welfare and Development (DSWD), ang ahensyang may tungkuling mamahala sa pagsasagawa ng public solicitations. Kaya naman, bago gumawa ng solicitation para sa mga charitable o public welfare na gawain, kinakailangan munang kumuha ng permit mula sa DSWD.


Upang sagutin ang iyong katanungan, sa pangkalahatan, ang lahat ng gustong magsagawa ng solicitation ay kailangan munang kumuha ng permit mula sa DSWD. Gayunpaman, sa ilalim ng Article V, Section B ng DSWD Memorandum Circular No. 9 series of 2024, na may petsang 7 Marso 2024 at kilala bilang Revised Guidelines in the Processing and Issuance of Regional and National Public Solicitation Permits, may mga nakasaad na mga exemptions o mga sitwasyon na hindi na kailangan pang kumuha ng public solicitation permit. Isa na rito ang public solicitation na isinasagawa ng mga paaralan, unibersidad o kolehiyo:


The following shall be exempted from securing public solicitation permits:


1. Organizations, agencies, and corporations created by laws that specifically confer them with authority to solicit for charitable, and/or public welfare purposes such as but not limited to United Nations (UN) Agencies, instruments, and missions as covered by the UN Charter;

2. Solicitation activities for religious purposes that are conducted by the members of the congregation within religious sanctuaries (e.g., construction of church, mosque, or any structure for worship; evangelization or propagation of faith; welfare program of the church or congregation to their members);


However, religious organizations conducting solicitation activities for charitable and public welfare activities shall be required to secure a solicitation permit from the DSWD.


3. Solicitation activities conducted within and among officemates, clan members, social/civic groups, or associations such as alumni associations, fraternities, or sororities:

4. Solicitation activities conducted by and within schools/universities/colleges for purposes of supporting scholars and infrastructure projects;

5. Caroling during Christmas seasons and other religious festivities;

6. Request for support of a person from government agencies such as but not limited to DSWD and LUs assistance programs whose mandate includes providing support or financial assistance such as but not limited to medical assistance, educational assistance, transportation assistance, and burial assistance; and

7. Fundraising activities conducted by the Sangguniang Barangay for Barangay Projects in accordance with Section 391 of RA No. 7160, undertaken only in one city or municipality as per Book Ill, Title II, Chapter 3 of RA No. 7160.”


Samakatuwid, ang solicitation na isinasagawa ng paaralan para sa layuning magpatayo ng isang multi-purpose gymnasium ay maaaring ma-exempt o hindi na kailangan pang kumuha ng permit, kung mapatutunayan na ang pangangalap ng donasyon ay tanging para lamang sa nasabing infrastructure project.
