Puwede bang ‘di tanggapin ng boss ang resignation?

Sinubukan kong magpasa ng resignation letter sa boss ko pero hindi siya pumayag. Legal ba ito? - Marybel


Dear Marybel,


Ang involuntary servitude o sapilitang pagtatrabaho ay hindi pinahihintulutan ng batas, alinsunod sa Article III ng Bill of Rights ng 1987 Constitution of the Philippines:


“Section 18. (2) No involuntary servitude in any form shall exist except as a punishment for a crime whereof the party shall have been duly convicted.”


Batay sa nabanggit na probisyon, hindi ka maaaring pilitin pang magtrabaho ng iyong boss. Gayunpaman, sinasabi ng batas na kung magre-resign sa trabaho ay kinakailangan ang hindi bababa sa isang buwan na advance notice – maliban kung may dahilan (ayon sa itinatadhana sa ilalim ng batas) na nagpapahintulot sa empleyado na magbitiw agad, o kung paikliin o i-waive ng employer ang nasabing one-month notice. Kung hindi ito susundin, maaaring pagbayarin ng danyos ang magre-resign na empleyado. Ito ay malinaw sa mga sumusunod na probisyon ng Labor Code of the Philippines:


“Art. 285. Termination by employee.

a. An employee may terminate without just cause the employee-employer relationship by serving a written notice on the employer at least one month in advance. The employer upon whom no such notice was served may hold the employee liable for damages.

b. An employee may put an end to the relationship without serving any notice on the employer for any of the following just causes:

1. Serious insult by the employer or his representative on the honor and person of the employee;

2. Inhuman and unbearable treatment accorded the employee by the employer or his representative;

3. Commission of a crime or offense by the employer or his representative against the person of the employee or any of the immediate members of his family;

4. Other causes analogous to any of the foregoing.”


Sana ay nabigyan namin ng linaw ang iyong katanungan. Ang payong aming ibinigay ay base lamang sa mga impormasyon na iyong inilahad at maaaring magbago kung mababawasan o madaragdagan ang mga detalye ng iyong salaysay.
