Pagtataguyod ng PhilATOM sa ‘Pinas

Dear Chief Acosta,

Sa panahon ngayon ay makikita ang patuloy na pag-unlad at pagsulong ng agham at teknolohiya. Isa sa mga madalas nating marinig ay ang patungkol sa tinatawag na enerhiyang nuklear. Dahil dito, nais ko sanang malaman kung may ahensya na ba ng gobyerno na may responsibilidad patungkol sa nasabing aspeto ng agham? — Robyn Santos

Ang sagot sa iyong katanungan ay matatagpuan sa Seksyon 6 ng Republic Act (R.A.) No. 12305, o kilala rin sa tawag na “Philippine National Nuclear Energy Safety Act,” kung saan nakasaad na:

“Section 6. Establishment of the Philippine Atomic Energy Regulatory Authority. - The Philippine Atomic Energy Regulatory Authority, otherwise known as "PhilATOM", is hereby established as an independent and quasi-judicial body. The PhilATOM shall have sole and exclusive jurisdiction to exercise regulatory control in accordance with this Act for the peaceful, safe, and secure uses of nuclear energy and radiation sources in the Philippines.

The regulatory functions of other government agencies with jurisdiction, functions, and authorities with respect to nuclear energy and radiation sources shall be transferred to the PhilATOM.”

Ayon sa nasabing probisyon na batas, ang Philippine Atomic Energy Regulatory Authority o kikilalanin din bilang "PhilATOM" ay itinatag bilang isang independiente at quasi-judicial body. Ito ay magkakaroon ng nag-iisa at eksklusibong hurisdiksyon upang isagawa ang pagkontrol sa regulasyon alinsunod sa batas upang matiyak ang mapayapa at ligtas na paggamit ng enerhiyang nuklear at mga pinagmumulan ng radiation sa ating bansa. Nais din naming ipaalam sa iyo na base sa nasabing batas, ang mga tungkulin sa regulasyon ng iba pang mga ahensya ng gobyerno na may hurisdiksyon, at awtoridad kaugnay ng enerhiyang nuklear at mga pinagmumulan ng radiation ay inilipat na sa PhilATOM.

Dagdag dito, nakasaad sa Seksyon 11 ng nasabing batas na ang PhilATOM ay kinakailangang bumuo at maglabas ng mga regulasyon, pamantayan, at gabay upang tukuyin ang mga prinsipyo, kinakailangan, at kaugnay na pamantayan kung saan nakabatay ang mga paghatol, desisyon, at aksyon nito sa regulasyon, samakatuwid:

“Section 11. Development of Regulations, Standards, and Guides. - The PhilATOM shall develop and issue regulations, standards, and guides to specify the principles, requirements, and associated criteria upon which its regulatory judgments, decisions, and actions are based; Provided, That these regulations, standards, and guides shall be periodically reviewed and revised by the PhilATOM as necessary to keep them up to date, with due consideration of relevant international safety and security standards, technical standards, good practices, and of relevant experience; Provided, further. That these regulations, standards, and guides shall set forth principles, requirements, and associated criteria commensurate with the radiation risks associated with the facilities and activities, in accordance with a graded approach. xxx”
