Kailan maaaring magkaroon ng karapatang sumali sa unyon ng paggawa ang isang empleyado? Maaari bang pagbawalan ng isang organisasyon ng paggawa ang isang empleyado na maging miyembro dahil sa mga subersibong aktibidad? — Charmender





Dear Charmender, 


Ang sagot sa iyong katanungan ay maaaring matagpuan sa ating mga batas at kaugnay na alituntunin. Para sa inyong kaalaman, nakasaad sa Department of Labor and Employment (DOLE) Order No. 40-C-05, 07 March 2005 ang sumusunod:


“Section 2. Who may join labor unions and workers' associations – All persons employed in commercial, industrial and agricultural enterprises, including employees of government owned and controlled corporations without original charters established under the Corporation Code, as well as employees of religious, charitable, medical or educational institutions whether operating for profit or not, shall have the right to self-organization and to form, join or assist labor unions for purposes of collective bargaining: provided, however that supervisory employees shall not be eligible for membership in a labor union of the rank-and-file employees but may form, join or assist separate labor unions of their own. Managerial employees shall not be eligible to form, join or assist any labor unions for purposes of collective bargaining.


Alien employees with valid working permits issued by the Department may exercise the right to self-organization and join or assist labor unions for purposes of collective bargaining if they are nationals of a country which grants the same or similar rights to Filipino workers, as certified by the Department of Foreign Affairs, or which has ratified either ILO Convention No. 87 and ILO Convention No. 98.


For purposes of this section, any employee, whether employed for a definite period or not, shall begin on the first day of his/her service, be eligible for membership in any labor organization.


All other workers, including ambulant, intermittent and other workers, the self-employed, rural workers and those without any definite employers may form labor organizations for their mutual aid and protection and other legitimate purposes except collective bargaining.” 


Hinggil sa nabanggit, ang sinumang empleyado, may takdang panahon man ang kanyang trabaho o wala, mula sa unang araw ng kanyang serbisyo, ay maaaring maging karapat-dapat na maging miyembro ng alinmang unyon ng paggawa.


Sa kaugnay na katanungan, nakasaad naman sa Artikulo 250 ng inamiyendahang Presidential Decree No. 442 o mas kilala sa tawag na Labor Code of the Philippines, ang mga sumusunod:


“Article 250. Rights and Conditions of Membership in a Labor Organization. – The following are the rights and conditions of membership in a labor organization:


(e)   No labor organization shall knowingly admit as members or continue in membership any individual who belongs to a subversive organization or who is engaged directly or indirectly in any subversive activity;


Ayon sa nasabing batas, walang organisasyon sa paggawa ang sadyang tatanggap bilang miyembro o magpapatuloy sa pagiging miyembro ng sinumang indibidwal na kabilang sa isang subersibong organisasyon, o tuwiran man o di-tuwirang sangkot sa anumang subersibong gawain.


Sana ay nabigyan namin ng linaw ang iyong katanungan. Ang payong aming ibinigay ay base lamang sa mga impormasyon na iyong inilahad at maaaring magbago kung mababawasan o madaragdagan ang mga detalye ng iyong salaysay.
