Paggamit ng ‘personal knowledge’ sa pagpapatupad ng warrantless arrest

Dear Chief Acosta,


Ang aking kapatid ay inaresto ng mga nagpakilalang operatiba ng NBI dahil sangkot daw siya umano sa isang kaso ng hazing, kung saan isa sa kanilang mga kaeskuwela ang namatay noong nakaraang linggo. Tinanong namin ang mga nasabing operatiba kung sila ba ay mayroong warrant of arrest, ngunit ang sabi nila ay warrantless arrest umano ang kanilang ginagawa sapagkat mayroon silang “personal knowledge” na nangyari ang isang krimen base sa testimonya ng dalawang testigo na positibong itinuturo ang aking kapatid. Dear Miel,


Ang sagot sa iyong katanungan ay tinalakay ng Korte Suprema sa kasong Roger Posadas, Rosario Torres-Yu and Marichu Lambino v. Ombudsman, G.R. No. 131492, Sept. 29, 2000, Ponente: Retired Honorable Associate Justice Jose C. Mendoza, kung saan sinabi ng Korte Suprema ang mga pamantayan para magkaroon ng “personal knowledge” ang isang arresting officer na magpapatupad ng isang warrantless arrest:


“Personal knowledge of facts in arrests without a warrant under Section 5 (b) of Rule 113 must be based upon "probable cause" which means an "actual belief or reasonable grounds of suspicion." The grounds of suspicion are reasonable when in the absence of actual belief of the arresting officers, the suspicion that the person to be arrested is probably guilty of committing the offense is based on actual facts, i.e., supported by circumstances sufficiently strong in themselves to create the probable cause of guilt of the person to be arrested. A reasonable suspicion therefore must be founded on probable cause, coupled with good faith on the part of the peace officers making the arrest. Indeed, at the time Dennis Venturina was killed, these agents were nowhere near the scene of the crime. When respondent Dizon and his men attempted to arrest Taparan and Narag, the latter were not committing a crime nor were they doing anything that would create the suspicion that they were doing anything illegal. On the contrary, Taparan and Narag, under the supervision of the U.P. police, were taking part in a peace talk called to put an end to the violence on the campus.”

Gaya sa kaso ng iyong kapatid, nakalipas na ang isang linggo at ang sinasabing “personal knowledge” ay base sa testimonya ng dalawang testigo. Hindi ito base sa mga pangyayari na kanilang nasaksihan o aktwal na mga kaganapan na maaaring makapagbuo sa kanilang isip na ang iyong kapatid ang maaaring gumawa ng nasabing krimen. Dahil dito, ang National Bureau of Investigation (NBI) ay dapat kumuha ng warrant of arrest mula sa isang hukom na siyang magdedetermina kung mayroon bang probable cause para arestuhin ang iyong kapatid. Dahil walang warrant of arrest ang NBI, ilegal ang ginawang pag-aresto sa iyong kapatid. Marapat lamang na siya ay palayain. Maaari rin kayong magsampa ng kaukulang kasong kriminal at administratibo laban sa mga operatiba ng NBI na umaresto sa iyong kapatid.

Sana ay nabigyan namin ng linaw ang iyong katanungan. Ang payo na aming ibinigay ay base lamang sa mga impormasyon na iyong inilahad at maaaring magbago kung mababawasan o madaragdagan ang mga detalye ng iyong salaysay.
