Multa at pagkakakulong sa magmamaneho nang lasing o nakagamit ng ilegal na droga

Hindi lingid sa ating kaalaman ang mga aksidenteng nangyayari sa lansangan na nagiging dahilan ng pagkawala ng buhay ng mamamayang kasama sa mga sitwasyong ito. Marami sa mga nagmamaneho sa lansangan ay hindi sumusunod sa kung ano ang itinatakda ng batas. Katulad na lamang sa mga nagmamaneho na nasa impluwensiya ng ilegal na droga o alak.

Dahil sa maraming insidente sa lansangan kung saan marami ang nakikitil na buhay dahil ang nagmamaneho ng sasakyan ay lasing o lango sa ipinagbabawal na droga, gumawa ang Kongreso ng batas na may layuning bigyang-kaparusahan ang mga taong napatunayang nasa impluwensiya ng ilegal na droga o alcohol habang nagmamaneho. Ito ay ang Republic Act (R.A.) No. 10586, o ang “Anti-Drunk and Drugged Driving Act of 2013”. Nakapaloob sa polisiya nito ang mga sumusunod:

“Section 2. Declaration of Policy. – Pursuant to the Constitutional principle that recognizes the protection of life and property and the promotion of the general welfare as essential for the enjoyment of the blessing of democracy, it is hereby declared the policy of the State to ensure road safety through the observance of the citizenry of responsible and ethical driving standards.

Towards this end, the State shall penalize the acts of driving under the influence of alcohol, dangerous drugs and other intoxicating substances and shall inculcate the standards of safe driving and the benefits that may be derived from it through institutional programs and appropriate public information strategies.”

Nilalayon ng batas na bigyang-kaparusahan ang pagmamaneho ng nasa impluwensiya ng alak, inuming nakalalasing o droga. Ito ay upang ipabatid sa kamalayan ng lahat ang panuntunan para sa ligtas na pagmamaneho at ng mga benepisyong makukuha ng mamamayan kapag disiplinado ang mga nagmamaneho sa mga lansangan.

Ayon sa Section 5 ng naturang batas, labag sa batas para sa tao ang magmaneho ng sasakyan habang siya ay nasa impluwensiya ng alcohol, ipinagbabawal na gamot o ng iba pang katulad nitong substansiya.

Kapag ang law enforcement officer ay mayroong batayan na ang nagmamaneho ay nasa impluwensiya ng alcohol, droga o ng iba pang katulad nitong substansiya dahilan sa mga klarong indikasyon, tulad ng “overspeeding” (sobrang bilis na pagmamaneho), swerving, biglaang paglilipat ng linya, biglaang pagtigil, mahinang koordinasyon o halatang amoy ng alcohol, siya ay mayroong tungkulin na isailalim ang nasabing nagmamaneho sa “field sobriety tests.”

Ang field sobriety tests ay mga klase ng pagsusuri upang malaman ang level ng pagkalasing ng nagmamaneho. Ito ay alinman sa mga sumusunod: horizontal gaze nystagmus, the walk-and-turn, the one-leg stand at ng iba pang uri ng pagsusuri na pagkakasunduan ng Department of Health (DOH), National Police Commission (NAPOLCOM), at Department of Transportation and Communications (DOTC).

Kapag ang nagmamaneho ay bumagsak sa pagsusuring ito ay tungkulin ng nanghuhuli na isailalim sa mas malalim na pagsusuri upang malaman ang blood alcohol concentration level ng nagmamaneho sa pamamagitan ng breath analyzer o ng katulad nitong instrumento.

Kapag ang nagmamaneho naman ay pinaniniwalaang nasa impluwensiya ng ipinagbabawal na gamot ay tungkulin ng nanghuhuli na dalhin ito sa pinakamalapit na istasyon ng pulis para sa drug screening test at kung kinakailangan ay sumailalim sa drug confirmatory test ayon sa mandato ng R.A. No. 9165.

Sa mga nagmamaneho naman na sangkot sa aksidente sa kalsada kung saan nagresulta ito sa pagkamatay o physical injuries ng mga kasangkot dito ay kinakailangang sumailalim sa chemical tests kasama ang drug screening test at kung kinakailangan ay sasailalim din sa drug confirmatory test para makita ang pagkakaroon at antas ng alcohol, droga o katulad nitong substansiya sa dugo at katawan ng nagmamaneho.

Ang sinumang mapatutunayang lumabag sa probisyon ng Section 5 ng nabanggit ng batas ay maparurusahan ng sumusunod:

“Section 12. Penalties. – A driver found to have been driving a motor vehicle while under the influence of alcohol, dangerous drugs and/or other similar substances, as provided for under Section 5 of this Act, shall be penalized as follows:

(a) If the violation of Section 5 did not result in physical injuries or homicide, the penalty of three (3) months imprisonment, and a fine ranging from twenty thousand pesos (Php20,000) to eighty thousand pesos (Php80,000) shall be imposed;

b) If the violation of Section 5 resulted in physical injuries, the penalty provided in Article 263 of the Revised Penal Code or the penalty provided in the next preceding subparagraph, whichever is higher, and a fine ranging from one hundred thousand pesos (Php100,000) to two hundred thousand pesos (Php200,000) shall be imposed;

(c) If the violation of Section 5 resulted in homicide, the penalty provided in Article 249 of the Revised Penal Code and a fine ranging from three hundred thousand pesos (Php300,000) to five hundred thousand pesos (Php500,000) shall be imposed; and

(d) The nonprofessional driver’s license of any person found to have violated Section 5 of this Act shall also be confiscated and suspended for a period of twelve (12) months for the first conviction and perpetually revoked for the second conviction. The professional driver’s license of any person found to have violated Section 5 of this Act shall also be confiscated and perpetually revoked for the first conviction. The perpetual revocation of a driver’s license shall disqualify the person from being granted any kind of driver’s license thereafter.”

Bukod sa mga nabanggit na kaparusahan, maaari pa ring sampahan ng kaso ng paglabag ng mga naangkop na probisyon ng Revised Penal Code, R.A. No. 9165, o ng iba pang batas o ordinansa na angkop sa nasabing paglabag.
