Mga kwalipikasyon upang maging isang lisensyadong criminologist

Dear Chief Acosta,

Ang kambal ko ay isang criminologist. May mga pagkakataon na nagpapanggap ako bilang siya upang tulungan siya sa kanyang mga kaso. Ngayon ay nais kong malaman kung paano ako magiging isang lisensyadong criminologist at kung maaari ba akong maparusahan sa pagpapanggap na ginawa ko. — Reginald

Dear Reginald, 

Kinikilala ng ating Estado ang kahalagahan ng propesyon ng kriminolohiya sa pambansang seguridad, kaligtasan ng publiko, kapayapaan at kaayusan, at sa pagbuo at pag-unlad ng bansa. Kaya naman, isinabatas ang Republic Act (R.A.) No. 11131 o mas kilala bilang "The Philippine Criminology Profession Act of 2018," upang makapagtaguyod ng mabuti, produktibo, at mahuhusay na mga criminologist na may mahusay at dekalidad na pamantayan ng propesyonal na serbisyo na pandaigdigang mapagkumpitensya sa pamamagitan ng sagrado, tapat, epektibo, at kapani-paniwalang mga pagsusulit sa lisensya, at sa pamamagitan ng mga programa at aktibidad na magtataguyod ng kanilang propesyonal na paglago at pag-unlad.

Gayundin, layunin ng batas na ito na mamahala sa pagsusuri, pagpaparehistro at pagbibigay ng lisensya para sa mga criminologist; pangangasiwa, pagkontrol at regulasyon ng pagsasagawa ng kriminolohiya, estandardisasyon at regulasyon ng edukasyon sa kriminolohiya, pagpapaunlad ng propesyonal na kakayahan ng mga criminologist sa pamamagitan ng continuing professional development (CPD), at ang pagsasama ng lahat ng mga grupo ng propesyonal sa criminologist, at pagiging miyembro ng lahat ng rehistradong criminologist sa kinikilalang propesyunal na organisasyon. Kaugnay nito, nakasaad sa Seksyon 14 ng batas na ito ang mga kwalipikasyon para maging isang criminologist:

“Section 14. Qualifications of an Applicant for the Licensure Examination. - An applicant for the licensure examination for criminologist shall satisfactorily prove that one possesses the following qualifications:

(a) Must be a citizen of the Philippines or a foreign citizen whose country/state has reciprocity with the Philippines in the practice of criminology;

(b) Must be of good moral character, good reputation and of sound mind and body certified by the school where he/she graduated and the barangay where he/she lives, unless the examinee is a foreign national a certification from any professional of good standing will do;

(c) Must hold a bachelor's degree in criminology duly accredited by the CHED and conferred by a school/college/university duly authorized by the government or its equivalent degree obtained by either a Filipino or foreign citizen from an institution of learning in a foreign country/state: Provided, That it is duly recognized and/or accredited by the CHED;

(d) Must not have been convicted of an offense involving moral turpitude by a court of competent jurisdiction; and

(e) Those who failed five (5) times whether consecutive or cumulative in the criminologist licensure examination, must present a certification issued by a reputable institution duly recognized by the CHED that such applicant has satisfactorily completed a refresher course in criminology.”

Gayundin, nais naming ipaalam sa iyo na ang iyong pagpapanggap bilang isang rehistradong kriminologo ay ipinagbabawal ng batas na ito sang-ayon sa Seksyon 37 (e) nito na:

“Section 37. Penal Clause. - A fine of not less than One hundred thousand pesos (P100,000) nor more than Five hundred thousand pesos (P500,000), or imprisonment for not less than two (2) years and one (1) day nor more than six (6) years, or both, at the discretion of the court shall be imposed upon any person who shall commit any of the following acts:

(e) Impersonating a registered criminologist or a holder of a temporary/special permit; and xxx”

Sana ay nabigyan namin ng linaw ang iyong katanungan. Ang payong aming ibinigay ay base lamang sa mga impormasyon na iyong inilahad at maaaring magbago kung mababawasan o madaragdagan ang mga detalye ng iyong salaysay.
