Mga ipinagbawal na gawain sa mga power line corridors

Ano po ang mga ipinagbabawal na gawain sa koridor ng mga linya ng kuryente? Nais ko po itong malaman para maiwasan ang paglabag sa batas. Salamat po sa iyo.

Dear Lola Liberata,

Ang sagot sa iyong katanungan ay matatagpuan sa Seksyon 6 ng Republic Act (R.A.) No. 11361, na kilala rin sa tawag na “Anti-Obstruction of Power Lines Act,” na nagsasaad na:

“Section 6. Prohibited Acts. - It is hereby declared unlawful for any person, whether natural or juridical, public or private, to:

1. Plant or cause to be planted tall growing plants, including plants of whatever kind, variety, or height within the power line corridor:

2.  Construct or erect any hazardous improvements within the power line corridor;

3. Conduct or perform any hazardous activities within the power line corridor;

4. Prevent or refuse duly authorized agents of the owner or operator of power lines, entry to the property in the performance of acts enumerated under Section 7: Provided, that such entry is in accordance with the provisions of Section 8; and

5. Perform other analogous acts or activities, which will impair the conveyance of electricity and cause damage to power lines.”

Bilang kasagutan sa iyong katanungan at ayon na rin sa nabanggit na probisyon ng batas, may mga akto o gawain na ipinagbabawal kaugnay ng koneksyon sa koridor ng mga linya ng kuryente (power line). Ang ilan sa mga ito ay ang mga sumusunod: a.) magtanim o magpatanim ng matataas na halaman, kabilang ang anumang uri o taas sa loob ng koridor ng mga linya ng kuryente; b.) magtayo ng anumang mapanganib na mga improvements sa loob ng koridor ng mga linya ng kuryente; c.) magsagawa ng anumang mapanganib na aktibidad sa loob ng koridor ng mga linya ng kuryente; at d.) magsagawa ng iba pang katulad na mga gawain o aktibidad, na makakasagabal sa paghahatid ng kuryente at magdudulot ng pinsala sa mga linya ng kuryente.

Para rin sa iyong kaalaman, binigyan ng kahulugan ang power line corridor sa Seksyon 5 ng nasabing batas at ito ay:

“Section 5. Power Line Corridor. - The land beneath, the air spaces surrounding, and the areas traversed by power lines including its horizontal, vertical, and similar clearance requirements shall constitute the power line corridor, which shall at all times be kept clear and free from any power line obstructions, dangerous structures, hazardous activities and improvements, and other similar circumstances in accordance with the provisions of this Act. 

In case where the power line corridor is wholly or partially located within a private property not owned by the owner or operator of the power lines, it shall constitute a legal easement upon the private property in accordance with the relevant provisions under Book II, Title VII, Chapter 2 of the Civil Code,”
