Nagpagawa ng swimming pool ang aming homeowners’ association sa aming subdivision ngunit ang paggamit nito ay may bayad kahit na ang gagamit naman ay mga residente ng aming lugar. May karapatan ba ang aming homeowners’ association para gawin ito? – May

Para sa inyong kaalaman, ang batas na nakasasaklaw sa inyong sitwasyon ay ang Section 10 (i) ng Republic Act No. 9904, o mas kilala sa tawag na The Magna Carta for Homeowners and Homeowners’ Associations, kung saan nakasaad na:


Section 10. Rights and Powers of the Association. – An association shall have the following rights and shall exercise the following powers: 
x x x
(i) Impose or collect reasonable fees for the use of open spaces, facilities, and services of the association to defray necessary operational expenses, subject to the limitations and conditions imposed under the law, the regulations of the board and the association’s bylaws.” (Binigyang-diin)

Samakatwid, ang homeowners’ association ay may karapatang magpataw o maningil ng makatwirang bayad para sa paggamit ng mga open spaces, pasilidad, o serbisyo ng nasabing asosyason, upang mapanatili nila ang operasyon ng mga ito. Ibig sabihin, may karapatan ang inyong homeowners’ association na maningil ng makatwirang bayad para sa paggamit ng swimming pool ng inyong subdivision, upang mapanatili nila nang maayos ang nasabing pasilidad.


Sana ay nabigyan namin ng linaw ang inyong katanungan. Ang payong aming ibinigay ay base lamang sa impormasyon na inyong inilahad at maaaring magbago kung mababawasan o madaragdagan ang mga detalye ng inyong salaysay.
