Maaaring makatanggap ng benepisyo mula sa SSS ang mga anak sa pagkadalaga

Ako ay housewife at gusto kong maging miyembro rin ng SSS tulad ng aking asawa. Maaari bang makinabang ang aking anak sa pagkadalaga para sa kanyang kinabukasan? – Renata


Dear Renata,


Nakasaad sa Republic Act (R.A.) No. 11199, o ang Social Security Act of 2018 na ang mga housewife tulad ninyo na ang buong atensiyon ay nasa pangangalaga ng inyong tahanan ay maaaring maging voluntary member o mag-miyembro sa Social Security System (SSS), ayon sa inyong kagustuhan. Narito ang partikular na probisyon ng R.A. No. 11199 ukol dito:


Section 9. Coverage – xxx (b) Spouses who devote full time to managing the household and family affairs, unless they are also engaged in other vocation or employment which is subject to mandatory coverage, may be covered by the SSS on a voluntary basis. Xxx”
Sa kabuuan, maaaring maging dependents ng bawat miyembro ang kanyang legal na asawa, mga anak na lehitimo, inampon sa legal na paraan, anak sa pagkadalaga o pagkabinata na hindi pa ikinakasal, walang hanapbuhay at hindi pa tumutuntong sa edad 21 maliban na lamang kung siya ay may kapansanan, at magulang na tumatanggap ng suporta mula sa miyembro. Ang mga nabanggit ang nakasaad sa Seksiyon 8 ng nasabing batas:
Section 8. Terms Defined. - For purposes of this Act, the following terms  shall, unless the context indicates otherwise, have the following  meanings:
 xxx (e) Dependents – The dependents shall be the following:
(1) The legal spouse entitled by law to receive support from the member;
(2) The legitimate, legitimated or legally adopted, and illegitimate  child who is unmarried, not gainfully employed, and has not reached  twenty-one (21) years of age,  or if over twenty-one (21) years of age, he is  congenitally or while still a minor has been permanently incapacitated and  incapable of self-support, physically or mentally:  and
(3) The parent who is receiving regular support from the member.  xxx
xxx (k) Beneficiaries – The dependent spouse until he or she  remarries, the  dependent legitimate, legitimated or legally adopted, and illegitimate children, who shall be the primary beneficiaries of the  member: Provided, That the dependent illegitimate children shall be  entitled to fifty percent (50%) of the share of the legitimate,  legitimated or legally adopted children: Provided, further, That in the absence of the dependent legitimate, legitimated or legally adopted children of the member, his/her dependent illegitimate children shall be entitled to one hundred percent (100%) of the benefits. In their absence, the dependent parents who shall be the secondary beneficiaries of the member. In the absence of all the foregoing, any other person designated by the member as his/her secondary beneficiary. xxx”

Samakatwid, maaaring makatanggap ng benepisyo mula sa Social Security System (SSS) ang inyong anak sa pagkadalaga, ngunit ito ay kalahati lamang ng bahagi ng inyong mga lehitimo at iba pang uri ng anak, kung mayroon man, maliban na lamang kung siya ang natatangi ninyong supling.


Nawa ay nasagot namin ang inyong mga katanungan. Ang opinyong ito ay nakabase sa inyong mga naisalaysay at sa pagkakaintindi namin dito. Maaaring maiba ang opinyon kung mayroong karagdagang impormasyon. Mas mainam kung personal kayong sumangguni sa abogado.
