Karapatan ng music composer

Dear Chief Acosta,

Ako ang composer ng kanta na balak gamitin ng aking kolehiyo sa paggawa ng music video para sa anniversary ng aming unibersidad. May karapatan ba ako sa copyright ng music video na ito? – Eli

Para sa inyong kaalaman, ang batas na nakasasaklaw sa inyong katanungan ay ang Section 178.5 ng Republic Act (RA) No. 8293, as amended, o mas kilala sa tawag na Intellectual Property Code of the Philippines, kung saan nakasaad na:

“178.5. In the case of audiovisual work, the copyright shall belong to the producer, the author of the scenario, the composer of the music, the film director, and the author of the work so adapted. However, subject to contrary or other stipulations among the creators, the producer shall exercise the copyright to an extent required for the exhibition of the work in any manner, except for the right to collect performing license fees for the performance of musical compositions, with or without words, which are incorporated into the work;”

Samakatwid, bukod sa producer nito,ang copyright ng music video ay ibinibigay din sa author of the scenario, the composer of the music, the film director at author of the work so adapted ng nasabing music video. Kaya naman, mayroon din kayong karapatan para sa copyright ng nasabing music video bilang composer ng nasabing kanta.

Nawa ay nasagot namin ang inyong mga katanungan. Nais naming ipaalala sa inyo na ang opinyong ito ay nakabase sa inyong mga naisalaysay sa inyong liham at sa pagkakaintindi namin dito.
