Karapatan ng mga may-ari ng pelikula laban sa ilegal na pagrerekord

Malinaw na nakasaad sa ilalim ng Republic Act (R.A.) No. 10088, o mas kilala bilang “Anti-Camcording Act of 2010,” ang mga ipinagbabawal na gawain, gaya ng sumusunod:

“Section 3. Acts Constituting Unauthorized Possession, Use and/or Control of Audiovisual Recording Devices. - It shall be unlawful for any person, at a time when copyright subsists in a cinematographic film or other audiovisual work or its soundtrack and without the authorization of the copyright owner or exclusive licensee thereof, to:

1. use or attempt to use an audiovisual recording device to transmit or make a copy of any performance in an exhibition facility of such cinematographic film or other audiovisual work or its soundtrack, or any part thereof; 

2. have in his/her possession, an audiovisual recording device in an exhibition facility, with the intent of using or attempts to use the audiovisual recording device to transmit or make a copy of any performance in the exhibition facility of such cinematographic film or other audiovisual work or its soundtrack, or any part thereof; or

3. aid, abet or connive in the commission of the acts prohibited under this section.”

Kung ating susuriin ang mga nabanggit, maliwanag na labag sa batas para sa sinumang tao, sa panahong umiiral ang copyright para sa isang cinematographic film o pelikula o iba pang audiovisual works o soundtrack nito, at walang pahintulot ng may-ari ng copyright o eksklusibong lisensyado, na gumamit o magtangkang gumamit ng audiovisual recording device upang magpadala o gumawa ng kopya ng anumang pagtatanghal sa pasilidad ng eksibisyon ng naturang cinematographic film o pelikula o iba pang audiovisual na gawa o soundtrack nito, o ng anumang bahagi nito. 

Ang audiovisual recording ay isang digital o analog na photographic o video camera, o anumang iba pang teknolohiya o gamit na may kakayahang paganahin ang pagrekord ng isang cinematographic film o iba pang audiovisual works, o anumang bahagi nito, kahit na ang nasabing audiovisual recording ay ang pangunahing layunin ng paggamit nito.

Ipinagbabawal din ang pagkakaroon o pagdadala ng isang audiovisual recording device sa loob ng isang exhibition facility kung ito ay may layuning gamitin o subukang gamitin upang mag-transmit o gumawa ng kopya ng anumang pagtatanghal ng naturang cinematographic film o pelikula, o iba pang audiovisual works o soundtrack nito, maging ng anumang bahagi nito. 

Ang sinumang tutulong, sasama o makikipagsabwatan sa paggawa ng mga ipinagbabawal na gawain ay maaaring parusahan, alinsunod sa batas:

“Section 4. Penalties. - A person who will be found guilty of violating the provisions of Section 3 shall be subject to a fine of Fifty thousand pesos (Php50,000.00) but not exceeding Seven hundred fifty thousand pesos (Php750,000.00) and imprisonment of six (6) months and one (1) day to six (6) years and one (1) day.

If the purpose of the commission of the abovementioned acts is the sale, rental or other commercial distribution of a copy of the cinematographic or audiovisual work or its soundtrack, or any part thereof, the penalty shall be imposed in the maximum.

If the offender is an alien, said person shall immediately be deported after payment of the fine and after serving his/her sentence. He/She shall thereafter be refused entry into the Philippines.

If the offender is a government official or employee, the penalty shall include perpetual disqualification from public office and forfeiture of his/her right to vote and participate in any public election for a period of five (5) years.”

Hindi maaaring gamitin bilang depensa ang pag-transmit o paggawa ng kopya ng cinematographic film o iba pang audiovisual works o soundtrack nito, o alinman sa bahagi nito, kahit pa ito ay para lamang sa pribadong layunin.
