Kahulugan ng Right of Way sa pagmamaneho

Ano ang depenisyon ng Right of Way sa usaping trapiko, lalo na sa isang interseksyon? –Benn

Dear Benn,

Ang sagot sa iyong katanungan ay matatagpuan sa ating mga batas, at kaugnay na desisyon ng ating Korte Suprema. Bilang panimula, nakasaad sa sumusunod na probisyon ng Republic Act Number 4136, o mas kilala sa tawag na "Land Transportation and Traffic Code," ang pamantayan patungkol sa Right of way, viz.:

Section 42. Right of way.

(a) When two vehicles approach or enter an intersection at approximately the same time, the driver of the vehicle on the left shall yield the right of way to the vehicle on the right, except as otherwise hereinafter provided. The driver of any vehicle traveling at an unlawful speed shall forfeit any right of way which he might otherwise have hereunder.

Partikular sa nabanggit, idinagdag ng Kataas-taasang Hukuman sa kasong Caminos v. People (G.R. No. 147437, 8 May 2009) na sinulat ni Retired Honorable Associate Justice Dante Tiñga, na ang Right of Way ay ang batas na tumutukoy sa karapatan, at ang preperesensya ng isang sasakyan na magpatuloy sa legal na pamamaraan—bagama’t mayroong kasalubong o kasabay na sasakyan:

“In traffic law parlance, the term "right of way" is understood as the right of one vehicle to proceed in a lawful manner in preference to another approaching vehicle under such circumstances of direction, speed and proximity as to give rise to a danger of collision unless one of the vehicles grants precedence to the other. Although there is authority to the effect that the right of way is merely of statutory creation and exists only according to express statutory provision, it is generally recognized, where no statute or ordinance governs the matter, that the vehicle first entering an intersection is entitled to the right of way, and it becomes the duty of the other vehicle likewise approaching the intersection to proceed with sufficient care to permit the exercise of such right without danger of collisions.”

Alinsunod sa nabanggit, ang sasakyan na naunang makapasok sa isang interseksyon ang mayroong Right of Way. Sa sitwasyon naman na sabay na nakarating sa isang interseksyon ang dalawang sasakyan, ang driver ng sasakyan na nasa kaliwa ay nararapat na magbigay-daan sa driver ng sasakyan na nasa kanan, ayon sa nasabing batas. Gayunman, ang isang driver na tumatakbo nang hindi akma sa bilis na itinakda ng batas ay tinatanggalan ng batas ng Right of Way at nararapat lamang na magbigay-daan.
