Flashing blue light o blinker sa motor, ipinagbabawal

Dear Chief Acosta,

Noong nagpapalit ako ng headlight ng motor ko mula sa isang shop, napansin ko ang kakaibang signal light na ikinakabit sa isang motor ng kasabayan ko na kustomer. Kulay blue ito at maganda dahil parang blinker na. Mura rin ito kaya binili ko na at ipinakabit sa mekaniko. Napansin ng mga kasamahan ko sa trabaho ang kakaiba kong signal light at may nakapagsabi na parang bawal ito. Totoo po ba na bawal ang ipinakabit kong signal light ng aking motor? Anong batas po ang nalabag ko, kung mayroon man? — Astonietta

Dear Astonietta,

Ang batas na sumasaklaw sa paggamit ng blinker sa isang motorsiklo ay ang Presidential Decree (P.D.) No. 96 na may petsang ika-13 ng Enero 1973. Ayon sa naturang batas:

1. That it shall be unlawful for the owner or possessor of any motor vehicle to use or attach to his vehicle any siren, bell, horn, whistle, or other similar gadgets that produce exceptionally loud or startling sound, including domelights, blinkers and other similar signalling or flashing devices.

2. The gadgets or devices mentioned above may be attached to and use only on motor vehicles designated for official use by the Armed Forces of the Philippines, National Bureau of Investigation, Land Transportation Commission, Police Departments, Fire Departments, and hospital ambulances.

Any device or gadget installed or mounted on any motor vehicle or otherwise used in violation of this decree shall be subject to immediate confiscation and, in cases of a second and subsequent offenses, the offender shall be prosecuted for violation of this Decree before the military tribunal and, upon conviction thereof, shall suffer the penalty of imprisonment for six months and/or a fine of 600 pesos. In addition, the certificate of registration of the motor vehicle on which the unauthorized gadget or device herein mentioned is installed, mounted or used shall be cancelled or revoked.”

Kaugnay nito, Sa Numero 2 at 3 ng Section 1 ng Department of Transportation Administrative Order No. 2024-001 na may petsang ika-18 ng Abril 2024, mahigpit na ipinagbabawal ang mga sumusunod:

“2.  Blinkers and/or any flashing lights of any colors installed in either front or rear of Motor Vehicle; and 

3.  Other similar signaling or flashing devices that actually impede and confuse traffic and which are inconsistent with sound traffic discipline and control on the highways.”

Sa ilalim din ng Section 2 ng nasabing kautusang administratibo:

“In the interest of safety and public welfare, the following attachments, gadgets and signaling and/or flashing devices shall be installed in each and every motor vehicle:

2.  Amber or yellow directional flashers installed in front or rear of the motor vehicle.

3. Hazard Warning Lamp shall be amber or yellow installed in front and rear of motor vehicles used to warn other motorists and pedestrian in case of emergency.”

Sa iyong sitwasyon, maliwanag na ang ipinakabit mong signal light na kulay asul at parang blinker sa iyong motor ay labag sa mga nabanggit na batas at alituntunin. Tanging amber o yellow (dilaw) ang awtorisadong kulay ng attachment na gaya ng signal light at hindi ito dapat parang blinker dahil hindi rin maaaring kabitan ng blinker ang iyong motor. Pinapayuhan ka namin na sumunod sa mga itinatakdang kulay at iba pang espesipikasyon ng mga aksesorya ng motor base sa mga umiiral na batas at alituntunin ng Land Transportation Office.
