Dear Chief Acosta,

Ako po ay may isang food processing business, na gumagawa ng iba’t ibang meat products. Minsan, ang ilan sa aming mga produkto, bagama’t ligtas kainin, ay hindi nakapapasa sa aming quality control standards, halimbawa na lamang kung ang produkto ay nailagay sa maling packaging, at ang pag-repack nito ay hindi naaayon sa aming proseso. Sa ganitong pagkakataon, ang mga nasabing produkto ay naitatalaga bilang “rejects” na kung saan, ito ay hindi na maaaring ibalik sa production line at kailangan nang itapon. Ako po ay nanghihinayang sapagkat ito ay naaaksaya lamang, kahit na ang mga ito ay ligtas kainin. Mayroon po bang batas na maaaring gumabay sa akin sa pag-dispose ng mga nasabing rejected products?

Dear Sarah,

Ang batas na sumasaklaw patungkol sa inyong katanungan ay ang Republic Act (R. A.) No. 9803o kinikilala bilang Food Donation Act of 2009. Ayon sa Sections 2 at 3(a) ng batas na ito:

“Section 2. Declaration of Policy. - It is the policy of the State to alleviate national poverty and reduce food wastage. As such, the State shall implement measures to encourage the donation of apparently wholesome food for charitable purposes.

(a) Apparently Wholesome Food” refers to food that meets all quality and labeling standards imposed by pertinent laws and administrative regulations even though the food may not be readily marketable due to appearance, age, freshness, grade, size, surplus, or other conditions. It does not include milk products as defined and covered under Executive Order No. 51, the “National Code of Marketing of Breastmilk Substitutes, Breastmilk Supplements and Other Related Products”

Alinsunod sa kaakibat nitong Implementing Rules and Regulations (IRR), ang sinumang nagnanais na magbigay ng pagkain bilang donasyon ay marapat na makipag-ugnayan sa Department of Social Welfare and Development (DSWD) o sa kanilang lokal na pamahalaan upang masigurado ang kaayusan at kaligtasan ng nasabing mga pagkain.

Sana ay nabigyan namin ng linaw ang inyong katanungan. Ang payong aming ibinigay ay base lamang sa mga impormasyon na inyong inilahad at maaaring magbago kung mababawasan o madaragdagan ang mga detalye ng inyong salaysay.
