Dear Chief Acosta,


Nais ngayon ng kapatid ko na magsampa ng reklamo laban sa kanyang kaopisina na nagpakalat ng maling balita sa social media na siya ay COVID-19 positive.


Pinaratangan din ang kapatid ko noong Christmas party nila na siya ay diumano nahawaan ng virus. Dahil dito ay na-discriminate siya at natatakot na bumalik sa trabaho ang kanyang officemates at siya ay makasalamuha. Ngunit ang totoo ay walang COVID-19 ang kapatid ko at may mga resulta siyang magpapatunay nito. May posibleng paglabag ba sa batas ang kaopisina ng kapatid ko kaugnay sa mga ginawa niya? – Xander


Dear Xander,


Ang maling paratang sa tao ay maaaring magdulot ng kasiraan nito. Kung kaya’t ipinagbabawal sa batas ang pagpapakalat ng tsismis at/o maling impormasyon. Ang kaso na maaaring maharap ng taong magsasabi o magpapakalat ng maling paratang ay ang krimen na slander o oral defamation. Malinaw na nakasaad sa Section 94 ng Republic Act No. 10951, na nag-amyenda sa Article 358 ng ating Revised Penal Code (RPC):


“Section 94. Article 358 of the same Act is hereby amended to read as follows:


Art. 358. Slander. — Oral defamation shall be punished by arresto mayor in its maximum period to prision correccional in its minimum period if it is of a serious and insulting nature; otherwise the penalty shall be arresto menor or a fine not exceeding twenty thousand pesos (₱20,000).”


Nais din naming bigyang-diin na sa ilalim ng Section 6 ng Republic Act No. 11469 o mas kilala bilang “Bayanihan to Heal as One Act”, mahigpit na ipinagbabawal ang pagpapakalat ng maling balita tungkol sa COVID-19. Ang sinumang mapatutunayang gumawa nito ay maparurusahan. Ayon sa nasabing probisyon ng batas:


“Section 6. Penalties. - In addition to acts or omissions already penalized by existing laws, the following offenses shall be punishable with imprisonment of two (2) months or a fine of not less than ten thousand pesos (P10,000.00) but not more than one million pesos (P1,000,000) or both, such imprisonment and fine, at the discretion of the court:

(f) Individuals or groups creating, perpetrating, or spreading false information regarding the COVID-19 crisis on social media and other platforms, such information having no valid or beneficial effect on the population, and are clearly geared to promote chaos, panic, anarchy, fear, or confusion; and those participating in cyber incidents that make use or take advantage of the current crisis situation to prey on the public through scams, phishing, fraudulent emails, or other similar acts; x x x”
