P100K kada araw na multa sa employer na hindi magre-report sa DOLE ng aksidente, panganib sa trabaho

Dear Chief Acosta,


Isa akong construction worker. Noong nakaraang linggo, naaksidente ang isa naming katrabaho sa aming pinagtatrabahuan, ngunit hindi ito iniulat sa Department of Labor and Employment (DOLE) Office. Pinagsabihan din kami ng aming supervisor na huwag i-report ang nasabing insidente. Tama ba ito? - Franco

Para sa inyong kaalaman, ang inyong katanungan ay tinatalakay sa Section 7 ng Republic Act (R.A.) No. 11058 o An Act Strengthening Compliance with Occupational Safety and Health Standards and Providing Penalties For Violations Thereof. Nabanggit sa probisyon ng batas na:


“Section 7. Workers' right to Report Accidents. - Workers and their representatives shall have the right to report accidents, dangerous occurrences, and hazards to the employer, to the DOLE and other concerned government agencies exercising jurisdiction as the competent authority in the specific industry or economic activity.”


Malinaw sa nasabing probisyon ng batas na ang manggagawa o ang kanyang kinatawan ay may karapatang i-report ang mga pangyayaring aksidente o anumang panganib sa kanilang pinagtatrabahuan sa kanilang employer, sa DOLE o sa ibang ahensiya ng gobyerno na may sakop dito. Ang paglabag sa nasabing probisyon ng batas ay maaaring magmulta ng hindi lalagpas ng ₱100,000 kada araw alinsunod sa Section 28 ng nabanggit na batas, kung saan nakasaad na:


“Section 28. Prohibited Acts. (a) Willful failure or refusal of an employer, contractor or subcontractor to comply with the required OSH standards or with the required OSH standards or with a compliance order issued by the Secretary of Labor and Employment or by the Secretary's authorized representative shall make such employer, contractor or subcontractor liable for an administrative fine not exceeding one hundred thousand pesos (P100,000) per day until the violation is corrected, counted from the date the employer or contractor is notified of the violation of the date the compliance order is duly served on the employer. xxx”


Sana ay nabigyan namin ng linaw ang inyong katanungan. Ang payong aming ibinigay ay base lamang sa impormasyon na inyong inilahad at maaaring magbago kung mababawasan o madaragdagan ang mga detalye ng inyong salaysay.
