Multa at kulong sa pagsasagawa ng dentistry nang walang lisensya

Dear Chief Acosta,

May pinsan ako na nagbukas ng klinika para sa kanilang bahay. Matagal na siyang nagsasagawa ng dentistry. Sa katunayan, ginagamit niya ang titulong D.M.D. sa kanyang pangalan. Dahil dito, naniwala kami na siya ay isang rehistradong dentista. 

Noong nakaraang buwan ay nalaman namin na hindi pala siya nakapasa sa board exam para sa dentistry. Hindi rin pala niya natapos ang kursong dentistry. Ngayon ay nag-aalala kami para sa kanya. Mapaparusahan ba siya sa ilalim ng batas? Maraming salamat po.

Dear Lyka Gesmundo,

Kinikilala ng batas ang mahalagang papel ng mga dental professional at layunin nitong tiyakin ang kanilang kakayahan, integridad, at mataas na pamantayan sa serbisyo. Kaya naman, ayon sa Sections 13, at 33 (a) at (h) ng Republic Act (R.A.) No. 9484 o ang “The Philippine Dental Act of 2007”:

“Sec. 13. Examination Required. - All applicants for registration for the practice of Dentistry, Dental Hygiene and Dental Technology shall be required to undergo a licensure examination to be given by the Board in such places and dates as the Commission may designate subject to the compliance with the requirements prescribed by the Commission in accordance with Republic Act No. 8981.

“Sec. 33. Penal Provision. - The following, shall be punished by a fine of not less than Two hundred thousand pesos (P200,000.00) nor more than Five hundred thousand pesos (P500,000.00) or to suffer imprisonment for a period of not less than two years and one day nor more than five years, or both, in the discretion of the court:

a. Any person who shall practice dentistry, dental hygiene or dental technology in the Philippines as defined in this Act, without a certificate of registration and professional identification card and special permit issued in accordance with the provisions of this Act, or has been declared exempt;

(h) Any person who shall assume, use or advertise as a bachelor of dental surgery, doctor of dental surgery, master of dental surgery, licentiate of dental surgery, doctor of dental medicine, or dental surgeon, or append to his name the letters D.D.S., B.D.S., L.D.S., or D.M.D. without having been conferred such title or degree in a legally constituted school, college or university, duly recognized and authorized to confer the same or other degrees;” (Emphasis supplied) 

Ayon sa nabanggit na batas, ang lahat ng nais magpraktis ng dentistry ay kailangang kumuha at makapasa sa licensure examination.

Ang sinumang magsasagawa ng dentistry nang walang sertipiko ng rehistrasyon, o gagamit ng titulong D.D.S., B.D.S., L.D.S., o D.M.D. nang hindi nakatapos at napagkalooban ng naturang degree mula sa isang kinikilalang paaralan, kolehiyo, o unibersidad, ay maaaring maparusahan ng multa na hindi bababa sa P200,000 at hindi hihigit sa P500,000, o pagkakakulong nang hindi bababa sa dalawang taon at isang araw at hindi hihigit sa limang taon, o parehong parusa ayon sa pagpapasya ng hukuman.

Upang sagutin ang iyong katanungan, maaaring managot ang iyong pinsan dahil nagsagawa siya ng dentistry nang walang lisensya at sertipiko ng rehistrasyon, at gumamit ng titulong D.M.D. kahit hindi niya natapos ang kinakailangang kurso at degree.
