Muling pagkuha ng Filipino citizenship

Dear Chief Acosta,

Ako ay ipinanganak sa Pilipinas at nagtungo sa Estados Unidos upang magtrabaho at kalauna’y nabigyan ako ng American citizenship. Noong nakaraang taon ay bumalik ako sa Pilipinas kasama ang aking 15 taong gulang na anak at balak namin na manirahan ng permanente sa Pilipinas. Nais kong malaman kung may paraan ba upang maibalik ang aking Filipino citizenship at kung maaari rin bang gamitin ito ng aking anak. - Lina

Dear Lina,

Para sa iyong kaalaman, maaaring makuhang muli o mare-acquire ang iyong Filipino citizenship sa bisa ng Citizenship Retention and Re-acquisition Act of 2003 (Republic Act [R.A.] No. 9225). Ayon sa Section 3 ng nasabing batas:

“Section 3. Retention of Philippine Citizenship - Any provision of law to the contrary notwithstanding, natural-born citizenship by reason of their naturalization as citizens of a foreign country are hereby deemed to have re-acquire Philippine citizenship upon taking the following oath of allegiance to the Republic:

“I _____________________, solemnly swear (or affirm) that I will support and defend the Constitution of the Republic of the Philippines and obey the laws and legal orders promulgated by the duly constituted authorities of the Philippines; and I hereby declare that I recognize and accept the supreme authority of the Philippines and will maintain true faith and allegiance thereto; and that I imposed this obligation upon myself voluntarily without mental reservation or purpose of evasion.”

Natural born citizens of the Philippines who, after the effectivity of this Act, become citizens of a foreign country shall retain their Philippine citizenship upon taking the aforesaid oath.

Section 4. Derivative Citizenship - The unmarried child, whether legitimate, illegitimate or adopted, below eighteen (18) years of age, of those who re-acquire Philippine citizenship upon effectivity of this Act shall be deemed citizenship of the Philippines.” (Binigyang-diin)

Sa iyong sitwasyon, maaaring maibalik ang iyong Filipino citizenship kung susundin mo ang prosesong itinalaga para rito, kabilang ang nabanggit na panunumpa ng katapatan sa Republika ng Pilipinas. Kasama ang iyong anak na wala pang 18 taong gulang na magkakaroon ng derivative citizenship alinsunod sa polisiya ng batas.

Para muling magawaran ng Filipino citizenship, magtungo lamang sa tanggapan ng Bureau of Immigration (BI) at magpasa ng sinumpaang petisyon para (1) mabigyan ng identification certificate; at (2) kanselasyon ng iyong alien certificate of registration, kung ikaw ay nakarehistro sa BI, alinsunod sa Memorandum Circular No. AFF-04-01 ng BI.
