Dear Chief Acosta,


Matagal nang hiwalay at may panibagong ka-“live-in” ang nanay namin. Magda-dalawang buwan na rin ang nakalipas mula nang mamatay ang aming tatay. Kaugnay nito, bukod sa mga anak tulad namin, maaari pa rin bang makakuha ng benepisyo sa pagkamatay ng aming tatay ang aming nanay mula sa Social Security System (SSS) kahit pa man nagkahiwalay na sila bago namatay ang aming tatay? – Fatima


Dear Fatima,


Ang sagot sa inyong katanungan ay hindi na po. Para sa inyong kaalaman, nakasaad sa Republic Act (R.A.) No. 11199, o mas kilala sa tawag na Social Security Act of 2018, at sa kaakibat na Implementing Rules and Regulations nito ang alituntunin tungkol sa mga benepisaryo na maaaring makatanggap sa Social Security System (SSS), viz:

k) Beneficiaries – The dependent spouse until he or she remarries, the dependent legitimate, legitimated or legally adopted, and illegitimate children, who shall be the primary beneficiaries of the member: Provided, That the dependent illegitimate children shall be entitled to fifty percent (50%) of the share of the legitimate, legitimated or legally adopted children: Provided, further, That in the absence of the dependent legitimate, legitimated or legally adopted children of the member, his/her dependent illegitimate children shall be entitled to one hundred percent (100%) of the benefits. In their absence, the dependent parents who shall be the secondary beneficiaries of the member. In the absence of all the foregoing, any other person designated by the member as his/her secondary beneficiary.
Implementing Rules and Regulation
SEC 12. PRIMARY BENEFICIARIES. - The following are considered as primary beneficiaries:
i. The dependent spouse who has not re-married [Sec 8, (k)], cohabited or entered in a “live-in” relationship before or after the death of the member, and
ii. The dependent legitimate, legitimated or legally adopted and illegitimate children. Where there are legitimate or illegitimate children, the former shall be preferred.  xxx.” (Binigyang-diin)

Ayon sa nabanggit, upang maging benepisaryo ang legal na asawa, nararapat na ito ay bukod sa nakadepende pa sa kanyang yumao na asawa. Una, hindi pa muling nagpakasal; o pangalawa, hindi pa pumasok sa panibagong relasyon kung saan mayroong “live-in relationship” nang naganap.


Alinsunod sa inyong sitwasyon, kapag mapatunayan ang pagkakaroon ng “live-in relationship” ng inyong nanay noong mamatay o bago pa mamatay ang inyong tatay, maaari itong maging epektibong dahilan upang hindi makatanggap ng benepisyo ang inyong nanay.


Nawa ay nasagot namin ang inyong mga katanungan. Nais naming ipaalala sa inyo na ang opinyong ito ay nakabase sa inyong mga naisalaysay sa inyong liham at sa pagkakaintindi namin dito. Maaaring maiba ang opinyon kung mayroong karagdagang impormasyong ibibigay. Mas mainam kung personal kayong sumangguni sa abogado.
