Dear Chief Acosta,

Isang relief operation ang isinagawa sa aming lugar dahil sa nagdaang bagyo. Ako at ang aking mga kaibigan ay nakatanggap ng relief goods, ngunit ibinenta nila ang sa kanila sa kanilang mga kakilala. Tinanong ako ng bumili kung nais ko ring ibenta ang aking relief goods, ngunit tumanggi ako. Maaari bang bilhin ninuman ang mga relief goods na ipinamigay sa mga biktima ng bagyo? – Matet

Dear Matet,

Ang sagot sa inyong katanungan ay matatagpuan sa Republic Act No 10121, o mas kilala sa tawag na “Philippine Disaster Risk Reduction and Management Act of 2010” at ng Rule16 at 17 ng Implementing Rules and Regulations (IRR) ng nasabing batas kung saan nakasaad na:

“RULE 16 – PROHIBITED ACTS

Section 1. Prohibited acts – Any person, group or corporation who commits any of the following prohibited acts shall be liable and be subjected to the penalties as prescribed in Section 20 of the Act and Rule 17 hereunder:

d. Buying, for consumption or resale, from the recipient disaster affected persons any relief goods, equipment or other aid commodities received by them; xxx”

“RULE 17 – PENAL CLAUSE

Section 1. Penalty, Fines – Any individual, corporation, partnership, association, or other judicial entity that commits any of the prohibited acts provided for in Section 19 of the Act shall be prosecuted and upon conviction shall suffer a fine of not less than fifty thousand pesos (Php50,000) or any amount not to exceed five hundred thousand pesos (Php500,000) or imprisonment of not less than six (6) years and one (1) day or not more than twelve (12) years, or both, at the discretion of the court, including perpetual disqualification from public office if the offender is a public officer, and confiscation or forfeiture in favor of the government of the objects and the instrumentalities used in committing any of herein prohibited acts. xxx”

Malinaw na nakasaad na ipinagbabawal ng batas ang pagbili ng mga relief goods na ipinamigay sa mga biktima ng kalamidad tulad ng bagyo. Ang sinumang mapatutunayang bumili nito upang ikonsumo o muling ibenta ay papatawan ng pagkakakulong, multa o pareho, batay sa nabanggit na batas, sa IRR nito at sa pagpapasya ng korte.
