Dear Chief Acosta,


Kami ay kapwa na senior citizens ng aking asawa. Dahil dito, at gawa na rin sa pananakot at karahasan ng mga nakatira malapit sa aming pagmamay-ari na lupa sa probinsiya ay naagaw at nakuha ang panghahawak o “possession” at pag-aari namin dito. Nakapagsampa na kami ng kaso na civil case para mabawi ang aming lupa. Gayunman, nais din naming malaman kung may kaakibat din bang kasong kriminal laban sa mga kumuha ng aming lupa. – Luis


Dear Luis,


Ang sagot sa inyong katanungan ay opo. Para sa inyong kaalaman, nakasaad sa Article 312 ng Act Number 3815 o mas kilala sa tawag na “Revised Penal Code,” na inamyendahan ng Republic Act (R.A.) No. 10951, ang krimen tungkol sa ilegal na pagkuha o pangangamkam ng lupa ng iba, viz:


Art. 312. Occupation of real property or usurpation of real rights in property. - Any person who, by means of violence against or intimidation of persons, shall take possession of any real property or shall usurp any real rights in property belonging to another, in addition to the penalty incurred for the acts of violence executed by him, shall be punished by a fine from fifty (50) to one hundred (100) per centum of the gain which he shall have obtained, but not less than fifteen thousand pesos (₱15,000).


If the value of the gain cannot be ascertained, a fine from forty thousand pesos (₱40,000) to one hundred thousand pesos (₱100,000) shall be imposed.”


Kaugnay ng nabanggit na batas, inilahad ng Korte Suprema ang mga requisites ng krimeng Occupation of Real Property sa kasong Quinao vs. People (G.R. No. 139603, July 14, 2000), isinulat ni Honorable former Associate Justice Santiago Kapunan:


“The requisites of usurpation are that the accused took possession of another’s real property or usurped real rights in another's property; that the possession or usurpation was committed with violence or intimidation and that the accused had animo lucrandi. In order to sustain a conviction for “usurpacion de derecho reales,” the proof must show that the real property occupied or usurped belongs, not to the occupant or usurper, but to some third person, and that the possession of the usurper was obtained by means of intimidation or violence done to the person ousted of possession of the property.” (Binigyang-diin)


Samakatwid, kung inyong mapatutunayan ang inyong pagmamay-ari o ownership sa lupa at ang katunayan na kayo ay napaalis sa inyong “possession” sa pamamagitan ng pananakot at karahasan ay maaaring managot sa krimeng nabanggit ang mga kumuha sa inyong lupa. Ang kaparusahan na multa ay bukod pa sa kaparusahang ipinapataw sa karahasan na kanilang ginawa sapagkat ang teksto ng batas ay malinaw na nagsasabing “in addition to the penalty incurred for the acts of violence executed by him.”


Nawa ay nasagot namin ang inyong mga katanungan. Nais naming ipaalala sa inyo na ang opinyon na ito ay nakabase sa inyong mga naisalaysay sa inyong liham at sa pagkakaintindi namin dito. Maaaring maiba ang opinyon kung mayroong karagdagang impormasyon na ibibigay. Mas mainam kung personal kayong sasangguni sa isang abogado.
