Dear Chief Acosta,


Ang aking anak ay kasalukuyang overseas Filipino worker (OFW) sa kabila ng kanyang pagiging menor de edad. Sa kasamaang-palad, isinumbong siya ng isa niyang kaibigan sa Philippine Overseas Employment Administration (POEA) kung kaya’t agaran siyang pinauwi. Nais ko lamang malaman kung maaari bang hindi siya sumunod sa POEA na nais na siya ay pauwiin sapagkat malaking halaga ang nagastos namin upang makapag-abroad siya? - Olivia

Para sa iyong kaalaman, nakasaad sa Section 9 ng Republic Act No. 10022 o ang batas na nag-amyenda sa Republic Act No. 8042, otherwise known as the Migrant Workers and Overseas Filipinos Act of 1995 na:


“Section 9. Section 16 of Republic Act No. 8042, as amended, is hereby amended to read as follows:

“SEC. 16. Mandatory Repatriation of Underage Migrant Workers. – Upon discovery or being informed of the presence of migrant workers whose ages fall below the minimum age requirement for overseas deployment, the responsible officers in the foreign service shall without delay repatriate said workers and advise the Department of Foreign Affairs through the fastest means of communication available of such discovery and other relevant information. The license of a recruitment/manning agency which recruited or deployed an underage migrant worker shall be automatically revoked and shall be imposed a fine of not less than five hundred thousand pesos (Php 500,000) but not more than one million pesos (Php 1,000,000). All fees pertinent to the processing of papers or documents in the recruitment or deployment shall be refunded in full by the responsible recruitment/manning agency, without need of notice, to the underage migrant worker or to his parents or guardian. The refund shall be independent of and in addition to the indemnification for the damages sustained by the underage migrant worker. The refund shall be paid within thirty (30) days from the date of the mandatory repatriation as provided for in this Act.” (Binigyang-diin)

Malinaw sa nabanggit na probisyon ng batas na sapilitan at agaran ang repatriation o pagpapauwi sa migrant worker na wala sa hustong gulang. Bukod pa rito, nakasaad din sa nabanggit na probisyon ng batas na nararapat na abisuhan ang Kagawaran ng Ugnayang Panlabas (Department of Foreign Affairs/DFA) sa pinakamabilis na paraan ng komunikasyon ukol dito. Gayundin, nakasaad din sa nasabing probisyon na ang lisensya ng ahensya na nagpadala sa nasabing menor de edad sa ibang bansa ay awtomatikong babawiin at papatawan ng multang nagkakahalaga mula limandaang libong piso (P500,000) hanggang isang milyong piso (P1,000,000). Karapatan din ng menor de edad na OFW na mabawi ang kanyang mga nagastos sa pagpo-proseso ng kanyang aplikasyon mula sa kanyang ahensya. Ito ay nararapat na maibalik sa kanya o kanyang magulang o guardian sa loob ng 30-araw matapos niyang makabalik sa Pilipinas. Iba pa ito sa kung anumang danyos na maaari pang maibigay sa kanya. Kaya naman, bagama’t hindi maaaring pigilan o tanggihan ang pag-repatriate ng iyong anak dito sa Pilipinas, may karapatan naman kayo na bawiin sa ahensyang nagpaalis sa kanya ang inyong binayad para sa pagproseso ng kaniyang aplikasyon.
