Naghain ng Petition for Certiorari sa Korte Suprema sina Senator-Judges Robin Padilla at Bong Go, kasama ang PDP-Laban at ilang abogado, upang ipawalambisa ang ruling ng Senate Impeachment Court na nagpababa sa voting threshold para ma-convict si Vice President Sara Duterte mula 16 tungo sa 14 na boto.


Sa ilalim ng bagong ruling, mga senador lamang na legal at aktuwal na maaaring lumahok sa impeachment proceedings ang isinasama sa basehan ng two-thirds vote. Dahil dito, 20 senador ang naging basehan at 14 na boto ang kinakailangan para sa conviction.


Iginiit naman ng mga petitioner na dapat manatili sa 16 ang kinakailangang boto dahil 24 ang kabuuang bilang ng mga miyembro ng Senado at malinaw umano sa Konstitusyon na two-thirds ng lahat ng miyembro ang kailangan para sa conviction.


Hiniling din nila sa Korte Suprema na maglabas ng Status Quo Ante Order o Temporary Restraining Order laban sa pagpapatupad ng naturang ruling.


Nauna nang ibinasura ng SC ang magkahiwalay na petisyon nina dating Executive Secretary Vic Rodriguez, Berteni Causing at Atty. Ernesto Francisco Jr. na kumukuwestiyon din sa bagong voting threshold, dahil sa procedural grounds gaya ng kawalan ng legal standing at prematurity.
