Death benefits ng seafarer na wala sa tamang pag-iisip

Dear Chief Acosta,
Ako po ay asawa ng isang seafarer. Noong nakaraang taon, nagkaroon ng insidente kung saan nag-amok diumano ang aking asawa at inatake nito ng kutsilyo ang kanyang kasamahan. Sa takot ng kanyang kasamahan ay ipinaglaban niya ang kanyang sarili kung saan nakuha niya ang kutsilyo at nasaksak niya ang aking asawa.
Ayon sa mga report na inilabas ng kanilang shipping company, ang nangyari diumano ay self-defense. Ayon din sa report, makailang ulit nang napansin na may pinagdadaanang mental health issues ang aking asawa gaya ng mga nakikitang tao o bagay na wala naman doon.
Nang ako ay mag-claim ng death benefits sa kanilang employer, ito ay kanilang tinanggihan sapagkat kasalanan diumano ng aking asawa kung bakit siya namatay. Wala na po ba talaga akong puwedeng makuhang death benefits?

Dear Maria,
Ang sagot sa inyong katanungan ay sinagot ng Korte Suprema sa kaso ng Interorient Maritime Enterprises, Inc., Et Al. vs. NLRC and Constancia Pineda (G.R. No. 115497, September 15, 1996, Ponente: Honorable Former Chief Justice Artemio V. Panganiban, Jr.), kung saan sinabi ng Korte Suprema na ang pagkamatay ng isang taong wala sa tamang pag-iisip ay hindi puwedeng sabihing “willful”. Dahil dito, ito ay hindi pasok sa exemption ng pagbabayad ng death benefits sa ilalim ng Philippine Overseas Employment Administration (POEA) Standard Format Contract of Employment for Seamen:
“xxx.. that since Pineda attacked the Thai policeman when he was no longer in complete control of his mental faculties, the aforequoted provision of the Standard Format Contract of Employment exempting the employer from liability should not apply in the instant case. Firstly, the fact that the deceased suffered from mental disorder at the time of his repatriation means that he must have been deprived of the full use of his reason, and that thereby, his will must have been impaired, at the very least.
Thus, his attack on the policeman can in no wise characterized as a deliberate, willful or voluntary act on his part. Secondly, and apart from that, we also agree that in light of the deceased’s mental condition, petitioners "should have observed some precautionary measures and should not have allowed said seaman to travel home alone", and their failure to do so rendered them liable for the death of Pineda. Indeed, "the obligations and liabilities of the (herein petitioners) do not end upon the expiration of the contracted period as (petitioner are) duty bound to repatriate the seaman to the point of hire to effectively terminate the contract of employment." Gaya sa inyong kaso, ang naging pag-atake ng iyong asawa sa kanyang kasamahan sa trabaho ay nangyari nang siya ay wala sa tamang pag-iisip. Dahil dito ang kanyang pagkamatay dahil sa nangyaring self-defense ay hindi maaaring ituring na deliberate, willful, o voluntary sa kanyang parte. Alinsunod dito, ito ay hindi sakop ng exemption sa willful causes of death sa ilalim ng POEA Standard Format Contract of Employment for Seamen.
