Dear Chief Acosta,


Noong taong 2014 ay nagkaroon po ako ng kanser sa baga, at sa awa ng Diyos, ako ay gumaling noong taong 2017. Mula noon ay regular pa rin akong nagpapatingin sa doktor upang masiguro ang aking kalusugan. Nais ko pong malaman kung may benepisyong medikal po ba na maibibigay ang gobyerno sa isang katulad kong cancer survivor?

Ang batas na sasagot sa inyong katanungan ay ang Republic Act (R. A.) No. 11215 o mas kilala bilang National Integrated Cancer Control Act, at ang Republic Act No. 7277, as amended by Republic Act No. 10754. Nakasaad sa Section 25 ng R.A. No. 11215 na:


SECTION 25. Persons with Disabilities. — Cancer patients, persons living with cancer and cancer survivors are considered as persons with disabilities (PWDs) in accordance with Republic Act No. 7277, as amended, otherwise known as the "Magna Carta for Disabled Persons." (Binigyang-diin)


Kaugnay nito, alinsunod sa Section 32 ng R. A. No. 7277, as amended by R. A. No. 10754, ang mga sumusunod na benepisyo ay marapat na ibigay sa isang PWD.


“SEC. 32. Persons with disability shall be entitled to:


(a) At least twenty percent (20%) discount and exemption from the value-added tax (VAT), if applicable, on the following sale of goods and services for the exclusive use and enjoyment or availment of the PWD:

(4) On medical and dental services including diagnostic and laboratory fees such as, but not limited to, x-rays, computerized tomography scans and blood tests, and professional fees of attending doctors in all government facilities, subject to the guidelines to be issued by the Department of Health (DOH), in coordination with the Philippine Health Insurance Corporation (PhilHealth);

(5) On medical and dental services including diagnostic and laboratory fees, and professional fees of attending doctors in all private hospitals and medical facilities, in accordance with the rules and regulations to be issued by the DOH, in coordination with the PhilHealth; […]”


Alinsunod sa mga nabanggit na probisyon ng batas, ang cancer survivors ay itinuturing na PWDs, matapos na sila ay maging kuwalipikado sa pamamagitan ng pagsumite ng mga dokumentong kinakailangan sa ilalim ng nasabing batas. Ilan sa mga benepisyong ibinibigay sa kanila bilang PWDs ay ang pagbibigay ng dalawampung porsiyentong (20%) diskwento at ang hindi pagbabayad ng VAT sa pagbili ng ilang produkto o pagkuha ng serbisyo, partikular ng ilang serbisyong medikal tulad ng diagnostic at laboratory fees.
