Batas para tiyakin ang kalusugan at kaligatasan ng mga batang Pinoy

Dear Mama Cris,

Ang sagot sa iyong katanungan ay matatagpuan sa Seksyon 2 ng Republic Act (R.A.) No. 12199, o ang “Early Childhood Care and Development System Act,” na nagsaad na:

“Section 2. Declaration of Policy. - It is hereby declared the policy of the State to safeguard and promote the right of every child to holistic well-being, growth, and dedicated care, reorganizing the age-appropriate stages of development. The State commits to creating nurturing environments for children that ensure a healthy and sustainable program for nutrition, age-appropriate development, and special protection will full recognition of the nature of childhood, as well as the necessity to provide developmentally appropriate experiences to address their needs. The State shall also support parents and parent-substitutes in their roles as primary caregivers and as their children’s first teachers. Further, the State hereby recognizes the age from zero (0) to eight (8) years as the first crucial stage of educational development. Without limiting the primary right and duty of parents to rear their children, the Early Childhood Care and Development (ECCD) Council shall be responsible for children below five (5) years of age, while the responsibility to help develop children in the formative years between age five (5) to eight (8) years shall be with the Department of Education (DepEd) consistent with Republic Act No. 10533 or the “Enhanced Basic Education Act of 2013.

Towards this end, the State shall institutionalize an ECCD System, as defined in Section 4 of this Act, that is comprehensive, integrative, and sustainable, even during times of emergency, that involves multisectoral and interagency collaboration at the national and local levels in the government; among the public and private sectors and non-government organizations (NGOs); and professional associations and academic institutions. xxx”

Ayon sa nasabing probisyon ng batas, ang pamahalaan ay kinakailangang magtayo ng tinatawag na Early Childhood Care and Development (ECCD) System na komprehensibo, integrative, at sustainable, at kinabibilangan ng multi-sectoral at inter-agency na makikipagtulungan sa pambansa at lokal na antas ng pamahalaan; sa mga nagbibigay ng serbisyo, pamilya at komunidad. Ang nasabing ECCD System ay kailangan itaguyod o isama sa sistema ang mga batang may espesyal na pangangailangan at itaguyod ang paggalang sa pagkakaiba-iba ng kultura. Ito ay dapat na nakaangkla sa mga pantulong na estratehiya para sa ECCD System na kinabibilangan ng paghahatid ng serbisyo para sa mga bata mula sa paglilihi hanggang sa edad na 4, pagtuturo sa mga magulang at tagapag-alaga, paghikayat sa aktibong pakikilahok ng mga magulang at komunidad sa mga programa ng ECCD, pagpapataas ng kamalayan tungkol sa kahalagahan ng ECCD, at pagtataguyod ng mga pagsisikap sa pagpapaunlad ng komunidad na mapabuti ang kalidad ng buhay para sa mga bata at pamilya.

Karagdagan dito, nais din namin ipabatid sa iyo na ang ilan sa mga layunin ng nasabing ECCD System ay ang pahusayin ang pisikal-motor, sosyo-emosyonal, wika, sikolohikal, at espirituwal na pag-unlad ng mga sanggol at mga bata; at bawasan ang mga rate ng pagkamatay ng mga sanggol at bata, at pagkatapos ay alisin ang mga maiiwasang pagkamatay, sa pamamagitan ng pagtiyak na sapat ang mga programa sa kalusugan at nutrisyon na malalapitan ng mga bata at kanilang mga magulang o tagapag-alaga. Ang mga ito ay nakasaad sa Seksyon 3 ng R.A. No. 12199, na:

Section 3. Objectives. - The ECCD System shall pursue the following objectives:

(a) Reduce infant and child mortality rates, and subsequently eliminate preventable deaths, by ensuring that adequate health and nutrition programs are accessible to young children and their parents and parent-substitutes, from the prenatal period through the early childhood years;

(b) Enhance the physical-motor, socio-emotional, cognitive, language, psychological, and spiritual development of infants and young children; x x x”

Kung kaya bilang kasagutan sa iyong katanungan, may batas na tumutukoy para pangalagaan at siguraduhin ang kalusugan at kaligtasan ng mga bata magmula sa kanilang pagkapanganak hanggang pagkabata o edad na apat. Ito ang nabanggit sa nasabing probisyon:

“Section 4. Definitions. – As used in this Act: xxx

(e) Early Childhood Care and Development (ECCD) System refers to the full range of health, nutrition, early childhood education and social services development programs that for the basic holistic needs of young children below five (5) of age, and promote their optimum growth and development. x x x”
