Walang namatay, tinanggal, o nag-resign — Azcuna... 16 boto pa rin para ma-convict si VP Sara

Nanindigan si retired Supreme Court Justice Adolfo Azcuna sa Senate Impeachment Court na ang two-thirds voting threshold sa impeachment ay dapat ibatay sa lahat ng 24 senador, hindi lamang sa mga present o aktuwal na boboto.

Si Azcuna ay isa sa mga amici curiae o “friends of the court” na hinirang ng Senate Impeachment Court upang magbigay ng legal na opinyon hinggil sa tamang voting threshold sa paglilitis kay Vice President Sara Duterte.

“Right now, no one is dead, no one has resigned, no one has been removed. We have 24 [senators]. So 24 is the denominator,” ani Azcuna.

Aniya, hindi permanenteng numerong 16 ang isinulat sa Konstitusyon dahil maaaring magbago ang kabuuang membership ng Senado.

“Supposing, God forbid, one is removed or one resigns, or one dies, then the denominator becomes 23. That’s why we did not put 16 because 16 is not always two-thirds,” paliwanag nito.

Sa kasalukuyang 24-member Senate, ang two-thirds ay 16 boto. Nauna nang sinabi ni Azcuna na ang simpleng absence, detention o suspension ng isang senador ay hindi awtomatikong nag-aalis sa kanya sa “all the members” na ginagamit sa impeachment threshold.
