Pirmado na ni Pangulong Ferdinand Marcos, Jr. ang Republic Act (RA) No. 12316 na nagbibigay sa Pangulo ng emergency powers. 


Batay sa Republic Act No. 12316, maaaring suspendehin o bawasan ng Pangulo ang excise tax sa langis kapag lumagpas ang average na presyo ng Dubai crude oil sa higit $80 kada bariles, sa pamamagitan ng rekomendasyon ng Development Budget Coordination Committee (DBCC) at koordinasyon ng Secretary of Energy.
