Dear Chief Acosta,


Ang aking asawa ay manggagawa sa shipyard. Siya ay humigit-kumulang anim na taon nang naglilingkod sa nasabing kompanya, ngunit siya ay paulit-ulit pa ring pinapipirma ng kontrata bilang “project employee”. Hindi ba ang paulit-ulit na pag-hire sa aking asawa at ang paggawa niya ng bagay na nauukol sa mismong negosyo ng kompanya ay dapat magresulta sa kanyang pagiging regular employee? - Donna


Dear Donna,


Ang sagot sa iyong katanungan ay sinagot ng Korte Suprema sa kaso ng Herma Shipyard, Inc. v. Danilo Oliveros, et al., G.R. No. 208936, April 17, 2017, na isinulat ni Kagalang-galang na Dating Mahistrado Mariano C. Del Castillo, kung saan sinabi ng Korte Suprema na ang paulit-ulit na pagkuha sa empleyado ay hindi awtomatikong nangangahulugan na siya ay regular employee. Ayon sa Korte Suprema:


“[T]he repeated and successive rehiring [of respondents as project-based employees] does not [also], by and of itself: qualify them as regular employees. Case law states that length of service (through rehiring) is not the controlling determinant of the employment tenure [of project-based employees but, as earlier mentioned], whether the employment has been fixed for a specific project or undertaking, with its completion having been determined at the time of [their] engagement." Stated otherwise the rule that employees initially hired on a temporary basis may become permanent employees by reason of their length of service is not applicable to project-based employees. Our ruling in Villa v. National Labor Relations Commission is instructive on the matter, viz.:


Thus, the fact that petitioners worked for NSC under different project employment contracts for several years cannot be made a basis to consider them as regular employees, for they remain project employees regardless of the number of projects in which they have worked. Length of service is not the controlling determinant of the employment tenure of a project employee. In the case of Mercado Sr. v. NLRC, this Court rule (sic) that the proviso in the second paragraph of Article 280, providing that an employee who has served for at least one year, shall be considered a regular employee, relates only to casual employees and not to project employees.” (Emphasis Ours)


Sang-ayon sa nasabing desisyon, ang haba ng panahon ng paglilingkod at ang paulit-ulit na pagkuha sa manggagawa ay hindi ang pangunahing basehan upang masabing siya ay regular employee. Ang dapat tingnan ay kung ang kanyang trabaho ay nakadepende sa tiyak na proyekto o gawain na ang pagtatapos ay tukoy na sa umpisa pa lamang ng kontrata o kasunduan. Kung ang pagkuha sa empleyado ay nakabatay sa tiyak na proyekto o gawain at may tukoy na panahon ng pamamasukan, siya ay mananatiling isang project employee kahit na siya ay paulit-ulit na kunin sa kaparehong trabaho.


Alinsunod sa mga nabanggit, hindi natin agad maaaring sabihin na regular employee na ang iyong asawa kahit siya ay paulit-ulit nang kinuha ng kanyang employer. Kailangan munang tingnan ang kontratang pinirmahan ng iyong asawa para silipin kung siya ay kinuha para sa mga tiyak na proyekto o gawain na ang pagtatapos ay tukoy na sa umpisa pa lamang ng kontrata. Kung oo, hindi siya maituturing na regular employee.
