Ako ay may dalawang lupang sakahan, ang isa ay may sukat na apat na ektarya at ang isa naman'y dalawang ektarya. Nais ko sanang gamitin ito upang mataniman ng palay at mais. Upang magawa ko ito ay kinakailangan kong kumuha ng tubig mula sa patubigan ng national irrigation system sa aming lugar. Gusto kong malaman kung mayroon bang tulong na maibibigay ang gobyerno kaugnay sa patubig ng aking sakahan. - Cris


Dear Cris,


Para sa iyong kaalaman, ang iyong katanungan ay binigyang-linaw ng Section 3 ng Republic Act No. 10969 o kinikilala bilang “Free Irrigation Service Act” at kaakibat nitong Implementing Rules and Regulations:


“SEC 3. Scope of Irrigation Service. – Upon the effectivity of this Act, all farmers with landholdings of eight (8) hectares and below are hereby exempted from paying irrigation service fee (ISF) for water derived from national irrigation systems (NIS) and communal irrigation systems (CIS) that were, or are to be, funded, constructed, maintained and administered by the National Irrigation Administration (NIA) and other government agencies, including those that have been turned over to irrigators associations (IAs).


Farmers with more than eight (8) hectares of land, corporate farms, and plantation drawing water for agricultural crop production; and fishponds and other persons, natural or juridical, drawing water for nonagricultural purposes from NIS and CIS, or using the irrigation systems as drainage facilities, shall continue to be subject to the payment of ISF.

Implementing Rules and Regulations


SECTION 4 - SCOPE OF FREE IRRIGATION SERVICE


Upon the effectivity of RA 10969, all farmers with landholdings of eight (8) hectares and below are hereby exempted from paying irrigation service fees (ISF) for water derived from national irrigation systems (NIS) and communal irrigation systems (CIS) that were, or are to be, funded, constructed, maintained and administered by the NIA and other government agencies, including those that have been turned over to irrigators associations (IAs).


Rule 4.1 - An exempted farmer or landowner is one who owns a total landholding of eight (8) hectares or less regardless of location, not necessarily contiguous farm lots but the aggregate of all the lots and parcels owned by a farmer or landowner who uses irrigation of facilities of any NIS or CIS.”


Ayon sa nabanggit na probisyon ng batas at kaakibat nitong Implementing Rules and Regulations, ang lahat ng magsasaka na nagmamay-ari ng lupang sakahan na may sukat na walong ektarya at pababa ay hindi na magbabayad pa ng irrigation service fees (ISF) para sa patubig buhat sa mga national irrigation systems (NIS), at maging mula sa communal irrigation systems (CIS) na pinondohan, ipinatayo at pinangangasiwaan ng National Irrigation Authority (NIA) at iba pang ahensya ng gobyerno. Ang mga nasabing magsasaka ay hindi na rin magbabayad ISF sa mga patubigan na inilipat sa pangangasiwa ng irrigators associations (IAs). Sa pagtuos ng walong ektaryang limitasyon, ikokonsidera ang lahat ng lupang pagmamay-ari ng magsasaka kahit saan pa matatagpuan ang mga ito.


Sa iyong sitwasyon, sa kadahilanang ang kabuuang sukat ng iyong lupang sakahan ay anim na ektarya lamang, ikaw ay hindi na magbabayad pa ng nasabing ISF sa mga nabanggit na patubig.


Sana ay nabigyan namin ng linaw ang iyong katanungan. Ang payong aming ibinigay ay base lamang sa impormasyon na iyong inilahad at maaaring magbago kung mababawasan o madaragdagan ang mga detalye ng iyong salaysay.
