Mayroon akong nakilala sa aking kasalukuyang trabaho, si MM. Naikuwento niya na ang kanyang pinsan na si AA ay may asawa na isang matandang lalaki, si XX. Si AA ay menor-de-edad at kasalukuyang nasa ikalawang taon sa high school, ngunit hindi niya alam kung ano ang ginawa ng kanyang mga magulang upang maikasal sila ni XX. Maaari kayang maghain ng reklamong kriminal si AA? Maparurusahan din kaya ang mga magulang ni AA kung sadyang mayroon silang ginawa upang maipakasal sina AA at XX? Sa kuwento lamang ni MM, hindi diumano gusto ni AA ang sitwasyon niya ngunit wala itong magawa dahil tila sang-ayon ang mga magulang niya sa pagsasama nila ni XX. Maaari kayang lumapit si MM at/o si AA sa inyong tanggapan kung sakaling nais niya na humingi ng tulong para magsampa ng reklamo? — Kristel
Dear Kristel,
Mahigpit na ipinagbabawal sa ilalim ng ating batas, partikular na sa ilalim ng Republic Act (R.A.) No. 11596, o mas kilala bilang “An Act Prohibiting the Practice of Child Marriage and Imposing Penalties for Violations Thereof,” ang pagpapakasal ng isang bata. Ang sinumang mapatunayan na gumawa, mag-ayos o mag-areglo sa nasabing kasal ay mapapatawan ng karampatang kaparusahan, kabilang na rito ang magulang, nakatatanda o tagapangalaga ng nasabing bata. Nakasaad sa Section 4 ng nabanggit na batas ang sumusunod:
“Section 4. Unlawful Acts. – The following are declared unlawful and prohibited acts:
(a) Facilitation of Child Marriage. – Any person who causes, fixes, facilitates, or arranges a child marriage shall suffer the penalty of prision mayor in its medium period and a fine of not less than Forty thousand pesos (P40,000.00): Provided, however, That should the perpetrator be an ascendant, parent, adoptive parent, step parent, or guardian of the child, the penalty shall be prision mayor in its maximum period, or fine of not less than Fifty thousand pesos (P50,000.00), and perpetual loss of parental authority: Provided, further, That any person who produces, prints, issues and/or distributes fraudulent or tampered documents such as birth certificates, affidavits of delayed registration of birth and/or foundling certificates for the purpose of misrepresenting the age of a child to facilitate child marriage or evade liability under this Act shall be liable under this section, without prejudice to liability under other laws: Provided, finally, That if the perpetrator is a public officer, he or she shall be dismissed from the service and may be perpetually disqualified from holding office, at the discretion of the courts; x x x”
Upang mabigyan ng legal na tulong at serbisyo si AA, maaari siya at/o ang kanyang pinsan na si MM na magsadya at sumangguni sa aming tanggapan. Para sa kaalaman ng lahat, ang Public Attorney’s Office (PAO) ay isa sa mga ahensya ng ating pamahalaan na naatasang magbigay ng serbisyo para sa mga biktima ng paglabag sa R.A. No. 11596. Ipinagtibay sa ilalim ng Section 9 ng Implementing Rules and Regulations (IRR) ng nabanggit na batas:
“Section 9. Institutional Arrangements. - The provisions of the Act shall be fully and promptly implemented by the following government departments and agencies within their respective jurisdictions. All duty bearers are mandated to report cases of child marriage and issue memoranda relative to child marriage. x x x
(g) Department of Justice (DOJ) - shall ensure that the penal provisions of this Act are carried out and provide access to justice and legal services to victim-survivors through the Public Attorney’s Office (PAO) or the Integrated Bar of the Philippines (IBP), as well as with non-government organizations and volunteer legal groups. x x x”
Ang aming PAO district offices ay karaniwang matatagpuan sa loob o malapit sa munisipyo, kapitolyo, city hall, o mga halls of justice ng bawat bayan, siyudad, o probinsya. Sa kanilang pagbisita sa aming district office, mangyari na dalhin nila ang lahat ng mga dokumento at/o ebidensya na mayroong kaugnayan sa legal na aspeto ng nabanggit na suliranin upang ito ay mapag-aralan, alinsunod sa batas at mga alituntunin ng aming tanggapan.
