Dear Chief Acosta,


Napilitan akong pumasok na kasambahay dahil kailangan ko ng pera. Aalis na sana ako sa probinsiya upang magtrabaho sa Maynila, ngunit tumanggi ang aking amo na sagutin ang gastos sa transportasyon. Gusto kong malaman kung sagutin ko ba ang nasabing gastos? – Marites



Dear Marites,


Ang sagot sa inyong katanungan ay matatagpuan sa Section 3, Rule II, ng Implementing Rules and Regulations (IRR) ng Republic Act No 10361o mas kilala sa tawag na “Domestic Workers Act” o “Batas Kasambahay”, na nagsaad na:


“Section 3. Deployment Expenses. – The employer, whether the Kasambahay is hired directly or through a PEA, shall pay the expenses directly used for his/her transfer from place of origin to the place of work.

The employer may recover deployment costs from the Kasambahay whenever the employment relationship is terminated within six (6) months without just cause.”

Malinaw na nakasaad sa nabanggit na probisyon na hindi ninyo dapat sagutin ang gastos sa transportasyon dahil obligasyong bayaran ng inyong amo ang gastos para sa paglipat ninyo mula sa inyong probinsiya patungo sa Maynila, kung saan kayo magtatrabaho bilang kasambahay.


Sana ay nabigyan namin ng linaw ang inyong katanungan. Ang payong aming ibinigay ay base lamang sa impormasyon na inyong inilahad at maaaring magbago kung mababawasan o madaragdagan ang mga detalye ng inyong salaysay.
