Pahintulot ng mga anak na teenagers, kailangan ng mag-asawa na nais mag-ampon

Dapat ba naming hinging mag-asawa ang consent o pahintulot ng aming mga anak na teenager bago kami makapag-ampon ng bata? - Douglas

Dear Douglas,

Para sa inyong kaalaman, ang batas na nakasasaklaw sa inyong katanungan ay ang Section 23 (c) ng Republic Act (R.A.) No. 11642 o mas kilala sa tawag na “Domestic Administrative Adoption and Alternative Child Care Act” kung saan nakasaad na:

“Section 21. Whose Consent is Necessary to the Adoption. – After being properly counseled and informed of the right to give or withhold approval of the adoption, the written consent of the following to the adoption are hereby required:

x x x

1. The legitimate and adopted children, ten (10) years of age or over, of the adopters, if any;

(d) The illegitimate children, ten (10) years of age or over, of the adopter if living with said adopter or over whom the adopter exercises parental authority and the latter’s spouse, if any; xxx” (Binigyang-diin)

Kaugnay nito, alinsunod sa Section 37 ng Implementing Rules and Regulations ng R.A. No. 11642, kabilang sa mga dokumentong kailangang ipasa at ikabit sa petisyon ng pag-ampon ay ang mga sumusunod:.

“Section 37. Documentary requirements for Adoiption of Legally Available Child. – xxx

(g) Written consent of marital and adopted children of PAP/s [prospective adoptive parent/s], ten (10) years of age or over;

(h) Written consent of non-marital children, ten (10) years of age or over, of whom the PAP/s is living with or over whom PAP/s exercises parental authority; xxx”

Sang-ayon sa nabanggit, ang written consent o nakasulat na pahintulot ng mga lehitimo at adopted na mga anak, na edad 10 o higit pa at pati na rin ng mga hindi lehitimong anak na edad 10 at pataas at kasama ng mag-aampon o nasa ilalim ng kanyang kustodiya ay kinakailangan bago matuloy ang pag-aampon o adoption ng bata. Ibig sabihin, ayon sa batas ay nararapat na kuhanin ninyo ang nakasulat na pahintulot ng inyong mga anak na teenager upang magpatuloy ang inyong balak na pag-aampon sa bata.
