Dear Chief Acosta,


Ako ay magpapakasal sa aking nobyo at isa sa mga rekisito na kailangan naming ihanda ay ang aming indibidwal na Certificate of No Marriage (CENOMAR). Subalit, natuklasan ko sa aking pagkuha ng CENOMAR na ako ay lumalabas na ikinasal sa isang tao na hindi ko kilala. Mayroon ding marriage certificate na naglalaman ng aking pangalan at impormasyon kaugnay sa kasal. Ang katotohanan ay walang naganap na kasal at ako ay walang kaalam-alam kung paano naitala ang pangalan ko sa nasabing marriage certificate.

Dear Janine,


Para sa inyong kaalaman, ang inyong katanungan ay saklaw ng Rule 108 ng Rules of Court (Cancellation or Correction of Entries in The Civil Registry). Nakasaad sa Sections1 at 2 ng Rule 108 na:


“Section 1. Who may file a petition. — Any person interested in any act, event, order or decree concerning the civil status of persons which has been recorded in the civil register, may file a verified petition for the cancellation or correction of any entry relating thereto, with the Court of First Instance of the province where the corresponding civil registry is located.


Section 2. Entries subject to cancellation or correction. — Upon good and valid grounds, the following entries in the civil register may be cancelled or corrected: (a) births: (b) marriage; (c) deaths; (d) legal separations; (e) judgments of annulments of marriage; (f) judgments declaring marriages void from the beginning; (g) legitimations; (h) adoptions; (i) acknowledgments of natural children; (j) naturalization; (k) election, loss or recovery of citizenship; (l) civil interdiction; (m) judicial determination of filiation; (n) voluntary emancipation of a minor; and (o) changes of name.”


Alinsunod sa mga nabanggit na probisyon, ang sinumang may interes sa kaganapan na may kinalaman sa civil status ng tao at kung saan ito ay naitala sa civil register ay maaaring magpetisyon sa korte alinsunod sa paraang itinakda ng Rule 108 ng Rules of Court upang makansela o maitama ang anumang maling entry kaugnay sa mga kaganapang nabanggit.


Kaugnay nito, sa kaso ng Republic of the Philippines vs. Melinda Olaybar (G.R. No. 189538, February 10, 2014, Ponente: Honorable Former Chief Justice Diosdado M. Peralta), pinahintulutan ng Korte Suprema ang pagwawasto ng marriage certificate sa pamamagitan ng pagkansela ng pangalan ng isa sa mga partido matapos mapatunayan sa hukuman, na siya ay hindi kailanman naging bahagi ng nasabing kasal na naitala sa civil register.
