Dear Chief Acosta,

Isa sa aking mga kaibigan ay pinagsususpetsahang mayroong human immunodeficiency virus (HIV). Dahil dito, siya ay binu-bully ng mga tao.

Maaari bang makasuhan o makulong ang mga nambu-bully sa kanya kapag napatunayan ito?

Dear Xyrel,

Para sa inyong kaalaman, ang inyong katanungan ay tinatalakay sa Republic Act No. 11166 o mas kilala bilang Philippine HIV and AIDS Policy Act. Nakasaad sa nasabing batas na:

“Section 49. Discriminatory Acts and Practices. - The following discriminatory acts and practices shall be prohibited. xxx

(i) Act of Bullying. - Bullying in all forms, including name-calling, upon a person based on actual, perceived, or suspected HIV status, including bullying in social media and other online portals xxx

Section 50. Penalties. - xxx

(g) Any person who shall violate any of the provisions in Section 49 on discriminatory acts and practices shall, upon conviction, suffer the penalty of imprisonment of six (6) months to five (5) years, and/or a fine of not less than fifty thousand pesos (P50,000), but not more than five hundred thousand (P500,000), at the discretion of the court, and without prejudice to the imposition of administrative sanctions such as fines, suspension or revocation of business permit, business license or accreditation, and professional license; ...” (Binigyang-diin).

Malinaw na nabanggit sa batas na ito na ipinagbabawal ang pambu-bully sa mga taong may human immunodeficiency virus (HIV) o pinagsususpetsahang may HIV. Ang sinumang mapatutunayang lumabag dito ay maaaring makulong ng anim na buwan hanggang limang taon at/o magmulta ng limampung libong piso (Php50,000) hanggang limandaang libong piso (Php500,000).
