Dear Chief Acosta,

Nalaman ko na paso na pala ang lisensiya ng kinuha naming landscape architect para gawin ang aming garden sa bahay. Ano ba ang parusa sa landscape architect na gumamit o nagtangkang gumamit ng expired na lisensiya? – Kent

Dear Kent,

Para sa inyong kaalaman, ang inyong katanungan ay tinatalakay sa Section 33 ng Republic Act No. 9053 o mas kilala sa tawag na “Philippine Landscape Architecture Act of 2000”, kung saan nakasaad na;

“Section 33. Illegal Practice of Landscape Architecture and Penalties. –

any person who shall attempt to use a revoked, suspended or invalid certificate of registration/professional license x x x shall upon conviction by the court suffer penalties.

The penalties for the mentioned illegal practices shall be a fine of not less than Fifty thousand pesos (P50,000), no more than two hundred thousand pesos (P200,000) or imprisonment of not less than six (6) months nor more than three (3) years, or both fine and imprisonment at the discretion of the court: Provided, That if the violation is committed by an alien, he/she shall be immediately deported after payment of fine or service of sentence without any further proceedings.”

Malinaw sa nabanggit na probisyon ng batas na pinapatawan ng kaukulang multa mula na P50,000 hanggang P200,000 at/o pagkakakulong mula anim na buwan hanggang tatlong taon ang sinumang gagamit o gumamit ng nareboka nang liseniya bilang landscape architect.
