Ako ay may nakasagutan sa Facebook Messenger. Marami akong nabitawang masasakit na salita sa kanya bugso ng aking damdamin. Nang matapos ang aming pag-uusap ay binantaan ako ng aking kaaway na kakasuhan niya ako ng cyber libel dulot ng aking mga mapanakit na salita. Cyber libel na ba talaga agad ang pakikipag-away ngayon sa private messaging apps online? - Melanie

Para sa iyong kaalaman, mayroong batas na nakasasaklaw sa iyong katanungan. Ayon sa Section 4(c)(4) ng Republic Act No. 10175 o ang “Cybercrime Prevention Act of 2012”:


“Section 4. Cybercrime Offenses. — The following acts constitute the offense of cybercrime punishable under this Act:

 x x x

 (c) Content-related Offenses: x x x

 (4) Libel. — The unlawful or prohibited acts of libel as defined in Article 355 of the Revised Penal Code, as amended, committed through a computer system or any other similar means which may be devised in the future.”

 

Kaakibat ng probisyong ito, nakasaad sa Articles 353 at 355 ng Revised Penal Code ang kahulugan ng Libel at kung paano ito ginagawa:

 

“Art. 353. Definition of libel. — A libel is public and malicious imputation of a crime, or of a vice or defect, real or imaginary, or any act, omission, condition, status, or circumstance tending to cause the dishonor, discredit, or contempt of a natural or juridical person, or to blacken the memory of one who is dead. x x x

 

Art. 355Libel means by writings or similar means. — A libel committed by means of writing, printing, lithography, engraving, radio, phonograph, painting, theatrical exhibition, cinematographic exhibition, or any similar means, shall be punished by prision correccional in its minimum and medium periods or a fine ranging from 200 to 6,000 pesos, or both, in addition to the civil action which may be brought by the offended party.”


Sang-ayon sa mga nabanggit na batas, ang Libel ay paninirang-puri na inilabas sa publiko upang ang taong tinutukoy ay mapahiya. Kapag ang paninirang-puri ay ginawa sa pamamagitan ng computer system, tulad ng paggamit ng online platform na Facebook, ito ay makokonsidera na bilang Cyber Libel.


Sa iyong sitwasyon, ang pribado ninyong pag-uusap ng iyong kaaway, hangga’t ito ay namamagitan sa inyong dalawa lamang at hindi inilabas sa publiko, ay hindi makokonsidera na Libel, o Cyber Libel.


Sana ay nabigyan namin ng linaw ang iyong katanungan. Ang payong aming ibinigay ay base lamang sa mga impormasyon na iyong inilahad at maaaring magbago kung mababawasan o madaragdagan ang mga detalye ng iyong salaysay.
