Maling representasyon ng kalidad ng produkto, paglabag sa Consumer Act

Dear Chief Acosta,

Na-engganyo akong bumili ng produkto na panglinis sa bahay na nakita ko kamakailan sa mall. Ang sinabi sa akin ng “promodiser” ay angkop diumano ito sa kalidad na hanap ko. Subalit noong sinubukan ko na sa aming bahay ay nasira agad ito makailang beses ko pa lamang nagamit. Nang subukan kong ayusin ay doon ko nadiskubre na “recon” o “refurbished” lamang pala ito at hindi orihinal tulad ng sinabi ng “promodiser”. Mayroon bang nilabag ang may-ari ng tindahan na pinagbilhan ko? – Pol


Dear Pol,

Mayroon tayong batas, ang Republic Act No. 7394 o mas kilala bilang Consumer Act of the Philippines”, na nagbibigay ng angkop na proteksiyon sa mga mamimili o consumers upang masiguro ang kanilang kaligtasan mula sa mga depektibo at mababa o walang kalidad na produkto, pati na rin sa mga mapanlinlang at hindi makatarungang paraan ng pagbebenta ng mga produkto.


Maaaring mayroong paglabag ang may-ari ng tindahan na pinagbilhan mo ng nabanggit mong produkto kung nagbibigay siya o ang kanyang mga sales personnel o representatives ng maling representasyon kaugnay ng kalidad ng kanilang produkto. Alinsunod sa Article 50 ng R. A. No. 7394:


“ART. 50. Prohibition Against Deceptive Sales Acts or Practices. — A deceptive act or practice by a seller or supplier in connection with a consumer transaction violates this Act whether it occurs before, during or after the transaction. An act or practice shall be deemed deceptive whenever the producer, manufacturer, supplier or seller, through concealment, false representation [or] fraudulent manipulation, induces a consumer to enter into a sales or lease transaction of any consumer product or service.


Without limiting the scope of the above paragraph, the act or practice of a seller or supplier is deceptive when it represents that:

b) a consumer product or service is of a particular standard, quality, grade, style, or model when in fact it is not;


c) a consumer product is new, original or unused, when in fact, it is in a deteriorated, altered, reconditioned, reclaimed or second-hand state;

Kung mapatunayang sadyang nilabag ng may-ari ng tindahan ang nabanggit na probisyon ng batas ay maaari siyang patawan ng fine at/o pagkakakulong at pagbayarin ng angkop na danyos. Malinaw na nakasaad sa Article 60 ng R. A. No. 7394 ang sumusunod:


“Article 60. Penalties. –


nnnnnnnnnnnnnnnn. Any person who shall violate the provisions of Title III, Chapter I, shall upon conviction, be subject to a fine of not less than five hundred pesos (P500) but not more than ten thousand pesos (P10, 000) or imprisonment of not less than five (5) months but not more than one (1) year or both, upon the discretion of the court.

In addition to the penalty provided for in paragraph (1), the court may grant an injunction restraining the conduct constituting the contravention of the provisions of Articles 50 and 51 and/or actual damages and such other orders as it thinks fit to redress injury to the person caused by such conduct.”


Sana ay nabigyan namin ng linaw ang inyong katanungan. Ang payong aming ibinigay ay base lamang sa impormasyon na inyong inilahad at maaaring magbago kung mababawasan o madaragdagan ang mga detalye ng inyong salaysay.
