Kaso sa gov’t employee na pumasok sa casino kahit 'di naglaro

Dear Chief Acosta,

Isa akong empleyado ng gobyerno. Ang pinsan ko na ikakasal sa isang buwan ay gustong ganapin ang kanyang bachelorette party sa isa sa mga sikat na casino sa Maynila. May nakapagsabi sa akin na bawal diumano maglaro sa casino ang mga opisyal at empleyado ng gobyerno. Nais ko po sanang malaman kung ipinagbabawal din ba kung ako ay dadalo lamang sa nasabing bachelorette party; iinom at manonood lamang nang hindi maglalaro sa casino. Kung sakaling mahuli ako sa ganitong sitwasyon, ano po ang maaaring maging pananagutan ko? – Mota

Dear Mota, 

Ayon sa Seksyon 2 ng Republic Act (R.A.) No. 6713, o mas kilala bilang “Conduct and Ethical Standards for Public Officials and Employees,” patakaran ng Estado na magsulong ng mataas na pamantayan ng etika sa serbisyo publiko. Dahil dito, ang mga opisyal at empleyado ng gobyerno ay dapat managot sa mga tao sa lahat ng oras. Dapat nilang gampanan ang kanilang mga tungkulin, nang may lubos na responsibilidad, integridad, kakayahan, at katapatan, kumilos nang may pagkamakabayan at katarungan, at itaguyod ang pampublikong interes kaysa sa pansariling na interes. 

Samantala, sa Memorandum Circular No. 6 na may petsang ika-20 Setyembre 2016 na inilabas ng Office of the President, inulit ang pagbabawal at idineklara pa na ang pagpasok lamang o presensya ng mga opisyal at empleyado ng pamahalaan sa isang casino ay dapat ituring na conduct prejudicial to the best interest of the service, maliban kung ito ay kaugnay sa pagganap ng mga opisyal na tungkulin at responsibilidad. Nakasaad pa rito na:

“NOW THEREFORE, in order to ensure the observance of the highest ethical standards among public officials and employees, the following are hereby ordered:

1. All government officials and employees shall strictly observe and comply with all pertinent laws, issuances and policies prohibiting government personnel to enter, stay, or play in gambling casinos.

2. All heads of departments, bureaus and offices, government-owned or controlled corporations and local governments, including those of the AFP and the Philippine National  Police, shall remind and reiterate to the officials and employees under them the above-stated laws, issuances and policies, and impose the appropriate sanctions and penalties in case of violation thereof.

In view of its negative effect on the public perception of government service as a whole, the mere entry or presence of government officials and employees in a gambling casino shall be considered as conduct prejudicial to the best interest of the service, unless the same was in the performance of official duties and functions.

3. The Philippine Amusement and Gaming Corporation Management shall ensure strict observance of this Circular by all government officials and employees.”

Kaugnay nito, ipinaliwanag ng Korte Suprema ang konseptong conduct prejudicial to the best interest of the service sa kasong Nicolas vs. Task Force Abono [G.R. No. 246114, July 26, 2023, sa panulat ni Honorable Associate Justice Antonio T. Kho, Jr.]:

“As matters now stand, conduct prejudicial to the best interest of the service is jurisprudentially characterized as ‘demeanor or conduct that tarnishes the image or integrity of the public service’ or those that ‘violate the norm of public accountability.’ Case law too has clarified that the conduct need not be related to or connected with the public officer's official functions.

With these characterizations, conduct prejudicial to the best interest of the service is considered broader as it encompasses all transgressions which may put a particular public office in a bad light.”

Sa iyong sitwasyon, kung isa kang empleyado ng gobyerno na napatunayang pumasok sa isang casino kahit hindi ka naglaro, maaari kang maharap sa administratibong kaso na "conduct prejudicial to the best interest of the service," na maaaring magresulta sa suspensyon o mas mabigat pang parusa depende sa kalubhaan at dalas ng paglabag.
