Maaari kayang maghain ng reklamo ang kaibigan ko para sa kalaswaan na ginawa sa nakababata niyang kapatid? Kamakailan ay inamin ng 10-taong gulang na kapatid ng aking kaibigan na hinimas-himas diumano ang kanyang ari ng kapitbahay nilang lalaki na halos ituring na diumano nila bilang tiyuhin. Iyak nang iyak diumano ang kanyang kapatid habang inaamin ang nakapanlulumong sinapit nito, kaya naman nais magsampa ng reklamong kriminal ng aking kaibigan upang mabigyan ng hustisya ang sinapit ng kapatid niya. Ulilang lubos na kasi sila at hindi naman niya maiwan ang responsibilidad ng pagrereklamo sa kanyang kapatid dahil sa mura nitong edad. Sana ay malinawan ninyo ako. — Grace
Dear Grace,
Ang paghipo, paghimas, o paghawak sa pribado o maselan na bahagi ng katawan ng isang bata, na magdudulot ng pagbaba ng dignidad nito at kapinsalaan sa kanyang emosyonal at sikolohikal na pag-unlad, ay itinuturing na isang uri ng sekswal na pang-aabuso. Ang sinumang gumawa ng nasabing akto ay maaaring sampahan ng reklamong paglabag sa Article 336 ng Revised Penal Code of the Philippines in relation to Republic Act (R.A.) No. 7610, o mas kilala bilang “Special Protection of Children Against Abuse, Exploitation and Discrimination Act”. Nakasaad sa Section 5 ng naturang batas ang sumusunod:
“Section 5. Child Prostitution and Other Sexual Abuse. – Children, whether male or female, who for money, profit, or any other consideration or due to the coercion or influence of any adult, syndicate or group, indulge in sexual intercourse or lascivious conduct, are deemed to be children exploited in prostitution and other sexual abuse.
The penalty of reclusion temporal in its medium period to reclusion perpetua shall be imposed upon the following: x x x
(b) Those who commit the act of sexual intercourse or lascivious conduct with a child exploited in prostitution or subject to other sexual abuse; Provided, That when the victims is under twelve (12) years of age, the perpetrators shall be prosecuted under Article 335, paragraph 3, for rape and Article 336 of Act No. 3815, as amended, the Revised Penal Code, for rape or lascivious
