Kaparusahan sa employers na hindi nagre-remit ng contributions sa Pag-IBIG

Dear Chief Acosta,

Ako ay security guard sa loob ng halos sampung taon. Noong ako ay nangailangan ng tulong o serbisyo mula sa ahensya ng Pag-IBIG, napag-alaman ko na hindi pala ito nahuhulugan ng aking employer. Ano ang karampatang parusa sa mga employer na hindi naghuhulog ng contributions ng kanilang empleyado sa Pag-IBIG? - Arcadio

Dear Arcadio,

Para sa iyong kaalaman, mayroong napagdesisyunang kaso ang Korte Suprema na nakasasaklaw sa iyong katanungan. Ayon sa Matalam v. People of the Philippines (G.R. Nos. 221849-50, April 04, 2016, Ponente: Honorable Justice Marvic Leonen):

“Similarly, the refusal or failure without lawful cause or with fraudulent intent to comply with the provisions of Republic Act No. 7742, with respect to the collection and remittance of employee savings as well as the required employer contributions to the Pag-IBIG Fund, subjects the employer to criminal liabilities such as the payment of a fine, imprisonment, or both.

Indeed, non-remittance of GSIS and Pag-IBIG Fund premiums is criminally punishable.”

Nakasaad din sa Section 25 ng Republic Act No. 9679 o ang “Home Development Mutual Fund Law of 2009” na:


“Section 25. Penal Provisions. — Refusal or failure without lawful cause or with fraudulent intent to comply with the provisions of this Act, as well as the implementing rules and regulations adopted by the Board of Trustees, particularly with respect to registration of employees, collection and remittance of employee-savings as well as the employer counterparts, or the correct amount due, within the time set in the implementing rules and regulations or specific call or extension made by the Fund management shall constitute an offense punishable by a fine of not less than, but not more than twice, the amount involved or imprisonment of not more than six (6) years, or both such fine and imprisonment, in the discretion of the court, apart from the civil liabilities and/or obligations of the offender or delinquent.”


Sang-ayon sa mga nabanggit, ang agency o employer ay kinakailangang maghulog ng kanilang kontribusyon para sa Pag-IBIG fund premium ng kanilang empleyado. Ang intensyonal na pagtanggi sa paghuhulog nito nang walang karampatang legal na dahilan at pag-iwas sa pagbabayad ng tamang kontribusyon ay maaaring mapanagot sa batas sapagkat ito ay may katumbas na kasong kriminal.


Ibig sabihin, hindi tama na ang iyong employer ay hindi nakapaghulog sa iyong Pag-IBIG premium sa loob ng halos sampung taon. Ang gawaing ito ay labag sa batas at maaari siyang makasuhan ng kasong kriminal.


Sana ay nabigyan namin ng linaw ang iyong katanungan. Ang payong aming ibinigay ay base lamang sa impormasyon na iyong inilahad at maaaring magbago kung mababawasan o madaragdagan ang mga detalye ng iyong salaysay.
