Dear Chief Acosta,

Ako po ay isa sa mga officers ng aming condominium association. Nais sana naming gumawa ng aksyon laban sa aming katabing gusali sapagkat ang ingay at init mula sa kanilang air conditioning unit ay nagdudulot na ng pasakit sa mga unit owners at lessees sa aming gusali. Ang ingay po ba na ito ay puwedeng ikonsiderang nuisance?

Ang sagot sa inyong katanungan ay sinagot ng Korte Suprema sa kasong Frabelle Properties Corp. vs. AC Enterprises, Inc. (G.R. No. 245438, November 3, 2020, Ponente:

Honorable Former Chief Justice Diosdado M. Peralta), kung saan nakasaad ang sumusunod:

“It is not enough that a person of peculiar temperament, unusual sensibilities or weakened physical condition, may be affected. Nor is a noise protected if persons of exceptional strength and robustness, or whose faculties have become benumbed by close business or other experience with it, are not disturbed. The pertinent inquiry is whether the noise materially interferes with the physical comfort of existence, not according to exceptionally refined, uncommon, or luxurious habits of living, but according to the' simple tastes and unaffected notions generally prevailing among plain people. The standard is what ordinary people, acting reasonably, have a right to demand in the way of health and comfort under all the circumstances. The number of people concerned by the noise and the magnitude of the industry complained of are both elements entitled to consideration in reaching a conclusion as to the fact.” (Emphasis Ours)

Ayon sa nasabing desisyon, hindi awtomatiko na kapag may ingay ay puwede na itong ideklarang nuisance. Sang-ayon sa Korte Suprema, titingnan kung ang ingay ay nagdudulot ng injury na higit sa reasonable limit. At ang reasonable limit na ito ay dapat sukatin sa pamantayan ng perception, sensibility at lifestyle ng isang ordinaryong tao. Ito ay pagkilala na may iba-ibang kakayanan ang tao sa ingay. Kaya’t kailangan mapatunayan sa korte hindi lamang ang injury, ngunit pati na ang injury na ito ay nangyayari sang-ayon sa pamantayan ng isang ordinaryong tao.
