Dear Chief Acosta,


Ako ay empleyado na nagtatrabaho sa kompanya nang pitong buwan. Noong nakaraang taon, ako ay kusang loob na umalis sa kompanya. Noong kinuha ko ang aking Certificate of Employment, nagtanong ako kung magkano ang aking separation pay at ang kanilang sinabi ay wala na diumano akong makukuha. Wala ba talaga akong separation pay? - Selena


Dear Selena,

Para sa iyong kaalaman, ang empleyado na kusang loob na umalis sa trabaho o nagsumite ng voluntary resignation ay makatatanggap lamang ng separation pay kung sakali na: 1) ito ay nakasaad sa collective bargaining agreement; 2) ito ay nakasaad sa kanyang employment contract; o 3) may established company policy ang kanyang kompanya o nakaugalian nito na magbigay ng separation pay sa mga empleyadong nag-voluntary resignation. Malinaw ito sa desisyon ng Kagalang-galang na Korte Suprema sa "J" Marketing Corporation Represented by its Branch Manager Elmundo Dador V. Cesar L. Taran (G.R. No. 163924, June 18, 2009, Ponente: Honorable Former Chief Justice Diosdado M. Peralta) kung saan nakasaad na:


“It is well to note that there is no provision in the Labor Code that grants separation pay to voluntarily resigning employees. Separation pay may be awarded only in cases when the termination of employment is due to (a) installation of labor-saving devices, (b) redundancy, (c) retrenchment, (d) closing or cessation of business operations, (e) disease of an employee and his continued employment is prejudicial to himself or his co-employees, or (f) when an employee is illegally dismissed but reinstatement is no longer feasible. In fact, the rule is that an employee who voluntarily resigns from employment is not entitled to separation pay, except when it is stipulated in the employment contract or collective bargaining agreement (CBA), or it is sanctioned by established employer practice or policy.” (Binigyang-diin)


Base sa nabanggit na desisyon, hindi ka makatatanggap ng separation pay sapagkat ikaw ay kusang loob na umalis sa iyong trabaho o voluntary resignation. Maaari ka lamang magkaroon ng separation pay kung ito ay nakasaad sa iyong kontrata o mayroong collective bargaining agreement o company policy ang kompanyang iyong pinasukan tungkol dito.
