Ibinasura ang kasong estafa sa mga nagpapanggap umanong staff ni Senador Sherwin "Win" Gatchalian dahil sa kakulangan ng ebidensya.
Nagpasya ang Pasay City Regional Trial Court Branch 115 na walang sapat na batayan ang kasong isinampa kina Dina Joson Castro, Ma. Luisa Barlan at sa isa pang akusado.
Matatandaang inaresto nu'ng Nobyembre ang ilang katao dahil sa reklamong naniningil umano ang mga ito para sa kontrata ng pagiging supplier sa reclamation projects sa Pasay City.
Nagbigay naman ng pahayag ang kapatid nina Joson at Barlan na si Emille Joson, isang award-winning international acclaimed filmmaker, "I'm very happy with the court's decision of course and I think we should respect it. The truth will always prevail. To Senator Gatchalian I know he means well but next time do a proper investigation. People voted him for a reason, so do something more humane and always get their fact straight."
Ayon naman sa abogado nina Joson at Barlan na si Atty. Vladimir Bugaring, "This order just shows that my client Dina Joson, Ma. Luisa Barlan and Helen Remolador has no participation on the alleged scam. The order even after requiring the prosecution through the NBI and the complainants found lack of probable cause to hold my clients for trial. That is why it ordered its dismissal in so far as Joson, Barlan and Remolador is concerned. Justice is in the air."
Iniutos naman ng National Bureau of Investigation (NBI) ang pagpapalaya sa tatlo at ituloy ang kaso laban kay Ryan Lester Dino at isa pang suspek.
Nanindigan naman ang mga suspek na sila'y inosente at hindi sila konektado sa sinasabing estafa.
