Dear Chief Acosta,


Ako ay nagkaroon ng sakit na kanser at sa kabutihang palad ay gumaling na ito matapos ang tatlong taon. Mula noong ako ay gumaling ay kinailangan kong magpatingin sa doktor at sumailalim sa iba’t ibang uri ng medical tests upang masiguro ang aking kalusugan.


May benepisyong medikal ba na maibibigay ang gobyerno sa tulad kong cancer survivor? - Alwyn

Para sa iyong kaalaman, ang iyong katanungan ay binigyang-linaw ng Section 25 ng Republic Act No. 11215 o kinikilala bilang “National Integrated Cancer Control Act” na nagsasabing:


“SECTION 25. Persons with Disabilities. — Cancer patients, persons living with cancer and cancer survivors are considered as persons with disabilities (PWDs) in accordance with Republic Act No. 7277, as amended, otherwise known as the "Magna Carta for Disabled Persons."

Kaugnay nito, alinsunod sa Section 32 ng Republic Act No. 7277, as amended by Republic Act No. 10754, ang mga sumusunod na benepisyong medikal ay marapat na ibigay sa person with disability (PWD).


“SEC. 32. Persons with disability shall be entitled to:


(a) At least twenty percent (20%) discount and exemption from the value-added tax (VAT), if applicable, on the following sale of goods and services for the exclusive use and enjoyment or availment of the PWD: xxx


(3) On the purchase of medicines in all drugstores;

(4) On medical and dental services including diagnostic and laboratory fees such as, but not limited to, x-rays, computerized tomography scans and blood tests, and professional fees of attending doctors in all government facilities, subject to the guidelines to be issued by the Department of Health (DOH), in coordination with the Philippine Health Insurance Corporation (PhilHealth);

(5) On medical and dental services including diagnostic and laboratory fees, and professional fees of attending doctors in all private hospitals and medical facilities, in accordance with the rules and regulations to be issued by the DOH, in coordination with the PhilHealth; […]”


Ayon sa mga nabanggit na probisyon, ang cancer survivors ay itinuturing na PWD, matapos na sila ay maging kuwalipikado sa pamamagitan ng pagsumite ng mga dokumentong kinakailangan sa ilalim ng nasabing batas. Ilan sa mga benepisyong ibinibigay sa kanila bilang PWDs ay ang pagbibigay ng dalawampung porsyentong (20%) diskwento at ang hindi pagbabayad ng VAT sa pagbili ng mga gamot at pagkuha ng serbisyong medikal, tulad ng diagnostic at laboratory fees. Bukod pa rito ang ibang mga prebilehiyo na ibinibigay ng batas sa PWD, tulad ng diskwento sa pamasahe at hotel accommodation, educational assistance at iba pa.
