Bawal ipagbili ang CPC sa pagbenta ng pampasaherong jeepney

Dear Chief Acosta,

Ako ay nagmamay-ari ng pampasaherong jeep at ito ay nais ko nang ipagbili sapagkat hindi ko na kaya pang ipagpatuloy ang pagbiyahe nito. Gusto kong malaman kung kasama ko bang maipagbibili ang Certificate of Public Convenience ng aking pampasaherong jeep upang ang makabibili nito ay maaaring pumasada? - Enrico

Ang batas na sumasaklaw patungkol sa inyong katanungan ay ang Commonwealth Act No. 146 o mas kilala bilang Public Service Act at ang Memorandum Circular No. 2016-010 ng Land Transportation Franchising & Regulatory Board (LTFRB). Nakasaad sa Section 15 ng Commonwealth Act No. 146 na:

“Section 15. With the exception of those enumerated in the preceding section, no public service shall operate in the Philippines without possessing a valid and subsisting certificate from the Public Service Commission known as "certificate of public convenience" or "certificate of public convenience and necessity," as the case may be, to the effect that the operation of said service and the authorization to do business will promote the public interests in a proper and suitable manner… xxx”

Kaugnay nito, nakasaad sa Memorandum Circular No. 2016-010 ng LTFRB na:

“NOW THEREFORE, this Board hereby PROHIBITS the acceptance of Application for Sale and Transfer or any form of conveyances of a Certificate of Public Convenience including involuntary sheriff’s sale by way of levy of execution of judgment or as a consequence of foreclosure proceedings.

In the event that public land transport operators would plan to discontinue or cease to operate as public land transportation providers, their CPCs should be surrendered and reverted back to the state through this Board.”

Ayon sa mga nabanggit na probisyon ng batas, ang Certificate of Public Convenience (CPC) ay kinakailangan ng sinumang nagnanais na magmaneho o mamasada ng pampublikong sasakyan. Nakasaad din sa nabanggit na memorandum circular na ang pagbibili at paglipat ng CPC ay mariing ipinagbabawal mula pa noong 2016. Ang operator ng pampublikong sasakyan na nagnanais nang ihinto ang pamamasada ay marapat ibalik ang CPC sa gobyerno sa pamamagitan ng LTFRB.
