Ang isang tao ay mayroong karapatan na kusang loob na ipagkaloob ang kanyang mga ari-arian sa ibang tao.
Ang kusang loob na pagbibigay ng ari-arian sa ibang tao nang walang hinihinging kapalit habang ang magbibigay ay nabubuhay pa, ay tinatawag na isang donasyon. Ito ay nakasaad sa Artikulo 725 ng New Civil Code of the Philippines:
“Article 725. Donation is an act of liberality whereby a person disposes gratuitously of a thing or right in favor of another, who accepts it.”
Upang maging epektibo ang isang donasyon, kinakailangan ang pagtanggap ng donee o ang pinagbigyan nito, sang-ayon sa nakasaad sa Artikulo 734 ng New Civil Code of the Philippines:
“Article 734. The donation is perfected from the moment the donor knows of the acceptance by the donee.”
Ang pagbibigay ng donasyon ng isang tao ay dapat din na naaayon sa mga limitasyon na isinasaad ng batas, katulad ng limitasyon na ang maaari lamang ibigay bilang donasyon ay iyong mga ari-arian na kasalukuyang pagmamay-ari ng magbibigay. Ito ay alinsunod sa batas kung saan nakasaad na:
“Article 750. The donation may comprehend all the present property of the donor, or part thereof, provided he reserves, in full ownership or in usufruct, sufficient means for the support of himself, and of all relatives who, at the time of the acceptance of the donation, are by law entitled to be supported by the donor. Without such reservation, the donation shall be reduced in petition of any person affected.”
Kaugnay nito, sinasabi naman ng Artikulo 751 ng pareho pa ring batas na ang future property o ang mga magiging ari-arian ng isang donor sa hinaharap ay hindi maaaring maging bahagi ng isang donasyon:
“Article 751. Donations cannot comprehend future property.
By future property is understood anything which the donor cannot dispose of at the time of the donation.”
