Magtanong Kay Atty. Persida Acosta

Dear Chief Acosta,

“Section 3. Definition of Terms. — For purposes of this Act, the following terms are hereby defined as follows:

(h) Without right refers to either: (i) conduct undertaken without or in excess of authority; or (ii) conduct not covered by established legal defenses, excuses, court orders, justifications, or relevant principles under the law.”

“Section 4. Cybercrime Offenses. — The following acts constitute the offense of cybercrime punishable under this Act:

  1. Offenses against the confidentiality, integrity and availability of computer data and systems:

  1. Illegal Access. – The access to the whole or any part of a computer system without right.”

The Secretary of Justice, et al., G.R. No. 203335, February 11, 2014, sa panulat ni Hon. Associate Justice Roberto A. Abad.

“Petitioners of course fear that this section will jeopardize the work of ethical hackers, professionals who employ tools and techniques used by criminal hackers but would neither damage the target systems nor steal information. Ethical hackers evaluate the target system’s security and report back to the owners the vulnerabilities they found in it and give instructions for how these can be remedied. Ethical hackers are the equivalent of independent auditors who come into an organization to verify its bookkeeping records.

Besides, a client’s engagement of an ethical hacker requires an agreement between them as to the extent of the search, the methods to be used, and the systems to be tested. This is referred to as the ‘get out of jail free card.’ Since the ethical hacker does his job with prior permission from the client, such permission would insulate him from the coverage of Section 4(a)(1).”
