Ang local traffic enforcers ay maaaring magsagawa ng field sobriety tests

Habang nagmamaneho, pinara ako ng local traffic enforcer at hinuli dahil swerving diumano ako. Gusto niya akong isailalim sa sobriety tests dahil sa kanilang palagay ay nakainom ako. May karapatan ba ang local traffic enforcer na gawin ito? - Janine
Dear Janine,
Para sa iyong kaalaman, ang batas na sumasaklaw sa iyong suliranin ay ang Republic Act (R. A.) No. 10586 o mas kilala bilang “Anti-Drunk and Drugged Driving Act of 2013.” Ayon sa Seksyon 6 ng nasabing batas:
“Section 6. Conduct of Field Sobriety, Chemical and Confirmatory Tests. – A law enforcement officer who has probable cause to believe that a person is driving under the influence of alcohol, dangerous drugs and/or other similar substances by apparent indications and manifestations, including overspeeding, weaving, lane straddling, sudden stops, swerving, poor coordination or the evident smell of alcohol in a person’s breath or signs of use of dangerous drugs and other similar substances, shall conduct field sobriety tests.
If the driver fails in the sobriety tests, it shall be the duty of the law enforcement officer to implement the mandatory determination of the driver’s blood alcohol concentration level through the use of a breathalyzer or similar measuring instrument.
If the law enforcement officer has probable cause to believe that a person is driving under the influence of dangerous drugs and/or other similar substances, it shall be the duty of the law enforcement officer to bring the driver to the nearest police station to be subjected to a drug screening test and, if necessary, a drug confirmatory test as mandated under Republic Act No. 9165.
Law enforcement officers and deputized local traffic enforcement officers shall be responsible in implementing this section.” (Binigyang-diin)
Sa ilalim ng nasabing batas, maaaring magsagawa ng sobriety tests ang tagapagpatupad ng batas kung mayroong probable cause na ang tao ay nagmamaneho habang nasa impluwensiya ng alak, ilegal na droga at iba pang kemikal base sa mga makikitang indikasyon. Ilan sa mga indikasyon na maaaring nakainom o nasa impluwensiya ng droga at iba pang kemikal ang taong nagmamaneho ay ang overspeeding, weaving, lane straddling, sudden stops, swerving, poor coordination at ang amoy ng alkohol sa hininga.
Ang nasabing obligasyon na magsagawa ng sobriety tests ay hindi lamang nakaatang sa mga tagapagpatupad ng batas, tulad ng kapulisan, kung hindi pati sa mga local traffic enforcers na itinalaga upang ipagpatupad ang batas. Kaugnay nito, ang Land Transportation Office (LTO) ang siyang naatasan na mag-deputize ng mga taong magpapatupad ng batas alinsunod sa Rule VI ng Implementing Rules and Regulations ng R.A. No. 10586.
Kaya naman, maaaring manghuli at magsagawa ng field sobriety tests ang mga local traffic enforcers kung sila ay itinalaga o deputized ng LTO para ipatupad ang R. A. No. 10586.
